I V. <br /> <br />PARK DEDICATION: <br /> <br />16. Cash C~)nlribttlion. The Plat is located in the Prairie Park District. Pursuant to the <br /> £ <br /> <br /> terms of he Wood Pond Hills development agreement, the DEVELOPER agrees to a <br /> cash parR dedication requirement in the amount of Six Hundred Dollars and no/cents <br /> ($600.00t per lot for a total of Nine Thousand Six Hundred Dollars and no/cents <br /> ($9,600.00). <br /> <br /> GENERAL <br /> <br />17.Tree an{l Sod Ptnnlinl2 Plan. Sodded boulevards are a requirement for each lot in the <br /> Plat prioi to issuance of a Certificate of Occupancy. In accordance with City Code and the <br /> policy esiablished by the City of Ramsey Park and Recreation Commission on June 10, <br /> 1993, the!DEVELOPER is required to submit a Landscape Plan for CITY approval that <br /> identifiesiexisting tree growth within the Plat that will be preserved during construction <br /> and new plantings. It is herein ag-reed that the requirement for a Landscape Plan shall be <br /> fulfilled B,y the DEVELOPER as follov,,s: <br /> <br /> a) Minimizing the impact of construction on trees in accordance with Minnesota <br /> E~ctension Service publication "Protecting:Trees From Construction Damage" <br /> (~ublication #NR-FO-6135-S). <br /> <br /> b) Pl.antinr one two-inch diameter tree (or equivalent thereof) of an approved species <br /> at!the road frontage or in the front yard of each of the lots in the Plat prior to the <br /> issuance of a Certificate of Occupancy. In the event the weather is not conducive <br /> to',tree or sod planting at the time of Certificate of Occupancy, the Building Permit <br /> hcSlder shall place a cash deposit in the amount of $200.00 for trees and $100.00 for <br /> so~ in an escrow account with the CITY and upon verification of the planting <br /> bding accomplished, said cash deposit shall be refunded to the Building Permit <br /> holder. Failure of the Builder to comply with the planting requirement within a <br /> reitsonable time frame following a determination by the CITY that weather <br /> conditions are conducive to planting shall give the CITY authority to cause the <br /> picturing, the cost of which shall be charged to the escrow account and the Builder <br /> sh ~11 not be eligible for a refund of the cash deposit made for this purpose. <br /> <br />qq <br /> <br /> <br />
