CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT . ESTATES <br /> <br />THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corporation of the State of Minnesota (the "CITY"), and KEITH ,.l. BORGESON <br />and KRISTI I3, BORGESON, husband and wife, whose address is 17014 St. Francis Blvd. <br /> ~ ' · ("the DEVELOPERS") <br />N.W., Ramsey, !M~nnesota <br /> <br /> WITNti}SSETIt: <br /> <br /> WHEI~EAS, the DEVELOPERS and Kelly A. Freidlund and ,Joan M. <br />Freidlund, husl~and and wife, are the fee owners of the following described property situated in <br />the CITY OF !RAMSEY, County of Anoka, State of Minnesota, and legally described as <br />follows: <br /> <br /> Lots 1, 2"and 3, Block 1, HAVEN ESTATES, Anoka Count3', Minnesota <br /> <br />the "Subject Property"; and <br /> <br /> WHERE[AS, on July 12, 1994, pursuant to Resolution :t~s94-07-. , the CITY approved <br />the final plat of She Subject Property which plat is known as HAVEN ESTATES (the "Plat") <br />contingent on c{rtain requirements, including DEVELOPERS and CITY entering into this <br />contract; and <br /> <br /> WHEREAS, the Plat consists of three lots totalling approximately 8.8 acres; <br /> <br /> WHERE~AS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Sub& 2) entitled "Division or Consolidation of Planed Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements hav~ been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. Lot 1 shall receive access from St. Francis Blvd. N.W., with an <br />alternate a~cess onto Potassium Court N.W. in the event the access onto St. Francis Blvd. <br />N.W. is elifiainated in the future. Lots 2 and 3 shall receive access from 168th Lane N.W. <br /> <br />Variance:. The CITY hereby grants a variance to the minimum street frontage <br />requiremeni on Lots 2 and 3. <br /> <br />Drainage and Utility Easements. Drainage and utility easements shall be dedicated to <br />the CITY a~ shown on the Final Plat. <br /> <br /> <br />
