CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br />DEVELOPMENrT AGREEN[ENT - GUY ADDITION <br /> <br />THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal co~oration of the State of Minnesota (the "CITY"), and the NEIL H. GUY <br />TRUST, whose address is 1380 Corporate Center Curve, 317 Eagandale Office, Eagan, <br />Minnesota 55I'21 ("the DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER represents the fee owner of the following described <br />property situat{~d in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally <br />described as follows: <br /> <br /> Lots 1, 2, 3 and 4, Guy Addition, Anoka County, Minnesota, <br />"the Subject PrOperty"; and <br /> <br /> WHER~EAS, on July 26, 1994, pursuant to Resolution ~t94-07-. , the CITY approved <br />the final plat Of the Subject Property which plat is known as GUY ADDITION (the "Plat") <br />contingent on :certain requirements, including DEVELOPER and CITY entering into this <br />agreement; and <br /> <br />WHEREAS, the Plat consists of four (4) lots totalling approximately three (3) acres; <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05!(Subd. 2) entitled "Division or Consolidation of Unplatted Lots". <br /> <br /> WHER~EAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. Ail lots in the Plat shall have access onto Hwy. 4/10 via no more than <br />two entrances onto Highway #10 located within the boundaries of the Plat. This shared <br />access o~to Highway #10 shall be provided for by the DEVELOPER in a private <br />easement~ agreement, prepared in recordable form, by and between each of the lots in the <br />plat. Thase access easements shall be recorded against the Plat at the County Recorders <br />Office. <br /> <br />Drainage and Utility Easements. Sixty foot drainage and utility easements shall be <br />provided ;along the north boundary of the Plat and 10 foot drainage and utility easements <br />shall be pi'ovided along all other property Iines. <br /> <br />II. <br />GENERAL <br /> <br />Park Dodication. In accordance with Subdivision 12 of Section 9.50.37 (Parks and <br />Open Space Dedication), Lot 4 is exempt from park dedication requirements. The park <br /> <br /> <br />
