CASE # <br /> <br /> 1995 LEGAL SERVICES <br />By: Ryan Schroeder, City Engineer <br /> <br />Background: <br /> <br />In late 1991, the City requested proposals for general legal and prosecution services from <br />area law fu-ms. On January 28, 1992, Council awarded a three-year contract to the firn~ of <br />Randall, D6hn and Goodrich. Within that contract were hourly rates for general legal of <br />$75 for 19912 and 1993 and $80 for 1994. Prosecution work was at $60 an hour for 1992, <br />$62 for 1998 and $65 for 1994. We also received "not to exceed" maximum annual costs <br />of $25,000 J~n 1992, $27,050 in 1993 and $29,250 for 1994 billable prosecution time. <br /> <br />With expiration of the above contract on December 31, 1994, we requested a proposal from <br />the existing !aw firm for 1995 through 1997. For general legal, Mr. Goodrich is proposing <br />to retain the hourly rate at 1994 levels for 1995 and I996 with an increase to $85 for 1997. <br />There are noiother changes proposed in the general legal area. <br /> <br />In the prosecution area, the current rate is proposed to increase to $67 in 1996 and $69 in <br />1997, with 0omplaint preparation increases in these years as well. The not to exceed <br />billings for ,~995, 1996 and 1997 are proposed to increase to $42,000, $46,200 and <br />$49,500, respectively. Additionally, cases brought to the State Court of Appeals are <br />proposed to 1Se exempted from the billing cap. <br /> <br />The attached letter (and contract) from Mr. Goodrich explains that the City saved $17,000 <br />in the prosectlfion area over the last three years due to the billing cap. It is for this reason <br />that he has requested a significant increase in the caps during the proposed contract period. <br /> <br />Council Action: <br /> <br />Motion to authorize the City Administrator to enter into a contract for general legal and <br />prosecution s~rvices for 1995, 1996, and 1997 with the firm of Randall, Dehn and <br />Goodrich. <br /> <br />Reviewed by: Copies also distributed to: <br /> <br />City Administrator <br />Finance Officer <br /> <br />City Attorney <br /> <br />FC: 07/26/94 <br /> <br />/jmt <br /> <br /> <br />
