We <br />have attempted to formulate a proposal for prosecution services <br />that includes a "not to exceed" clause in regards to total <br />prosecution billings for 1995, 1996, and 1997. By this letter we <br />would like to explain how we arrived at our proposal for <br />prosecution services. <br /> <br /> Prosecutions have been increasing rapidly in the City. We <br />assume this is due to the City's increased population and resulting <br />additions to the police force. Since the first year of our present <br />contract in 1991, the police department has added one additional <br />full time officer and we understand requests have been made for <br />additional officers during the next three years as well. <br />Additionally, the State legislature has continued to increase the <br />number of gross misdemeanor offenses and has mandated strict arrest <br />procedures involving domestic assaults which has also contributed <br />to the need for additional municipal prosecution services. <br /> <br /> In 1992, total prosecution fees for the City were $27,.1.67.15 <br />with 452.5 bouts of legal services expended. In 1993, total <br />prosecution fees increased to $33,947r~5 representing 547.5 hours <br />of legal services. Based upon a review of the prosecution services <br />provided through the first six months of 1994, another increase in <br />the total actual prosecution hours is projected for 1994. <br />Currently, the average prosecution billings for the first six <br />months of 1994 have been $3,106o00 per month. This would project <br />out to an annual prosecution fee of ~7,28.1.12 for 1994 <br />representing 573.5 hours of legal services. <br /> <br /> As is apparent the "not to exceed" clause in the current <br />contract has resulted in the actual fees received by our firm being <br />considerably less than had we'been paid for all hours actually <br /> <br /> <br />
