e) <br /> <br />The development of the remaining lot and outlot with the 12 townhomes will <br />exhaust the subdivision of developable land and bring final closure to the PUD <br />which was initiated in 1984, prior to implementation of the 4 in 40 density <br />provisions. <br /> <br />Given the addendum to the Rum River Hills development agreement described in the first <br />paragraph of this memo, it is Staffs opinion that the City should accept Mr. Domes application for <br />preliminary plat approval of the townhome development with or without benefit of established <br />criteria for review purposes. Staff is recommending that the developer proceed to apply for <br />preliminary plat approval and the review will take into consideration the above listed reasons for <br />allowing the completion of the Rum River Hills PUD for ex-urban development along with the <br />following issues: <br /> <br />The development must have a city-wide focus meaning that there are other amenities in the <br />development as a whole and as a facet of any proposed plat revisions which tend to benefit <br />residents from all parts of the City. <br /> <br />The development must promote sound planning decisions. <br /> <br />The development proposal must be located within the boundaries of the development <br />providing the public amenity. <br /> <br />:The development should maintain a density level that assures or improves the rural <br />character of the development. <br /> <br />Council could direct Staff to prepare an ordinance on the ex-urban development, or direct the <br />applicant, Mr. Bill Dom, to submit a preliminary plat for review, or "other". <br /> <br />Council Action: <br /> <br />Based upon discussion. <br /> <br />Reviewed by: <br /> <br />City, Administrator <br />Zoning Administrator <br /> <br />CC: 09/12,/94 <br /> <br />Copies distributed to: <br /> <br />City Attorney <br />City Engineer <br />Economic Development Coordinator <br /> <br /> <br />
