Tree Protection Policy Authority <br /> <br />Minnesota State Statutes: <br /> <br />17.86 Subd. 6. Municipal Action. A city of the first or second class shall, by ordinance, <br />require of the developer the use of properly placed trees in new subdivisions and plantings on <br />lands dedicated to parks and open spaces. Cities of the third and fourth class may adopt such <br />ordinances. Counties may assist and encourage tile smaller cities in tree planting programs. A <br />municipality may contract on a long-term basis with nurseries and shade tree wholesalers to assure <br />continued availability of nursery stock of the desirable shade u'ee varieties. <br /> <br />412.221 Subd.8. Parks, trees. The council shall have power to provide for, and by ordinance <br />regulate, the setting out and protection of trees, shrubs, and flowers in the city or upon its <br />property. <br /> <br />448.56 Subd. 2. Superintendence. The board of park commissioners shall have authority to <br />direct, superintend, and regulate the planting, culture, and preservation of shade and ornamental <br />trees, shrubbery, and turf in the streets, avenues, alleys, and public grounds of the city, and in <br />such parts thereof as may be lawfully placed under the jurisdiction and control of tile board of park <br />commissioners... <br /> <br /> <br />
