the Work of the various trades and the Engineer shall pass upon them with reasonable promptness. <br />The Contractor shall make any corrections required by the Engineer, file with the Engineer two (2) <br />corrected copies and furnish such other copies as may be needed. The Engineer's approval of such <br />drawings or schedules shall not relieve the Contractor from responsibility for deviation from Plans or <br />Specifications, unless the Contractor has, in writing, called the Engineer's attention to such deviation <br />at the time of submission, nor shall it relieve the Contractor from responsibility for errors of any sort <br />in Shop Drawings or schedules. <br />4.4 Unless otherwise set forth in the Contract Documents or bidding documents, it shall be the <br />Contractor's sole responsibility to determine subsoil conditions prior to the bidding of the job. If <br />under the terms of the Contract Documents, the responsibility for subsoil conditions is with the <br />Contractor, Contractor hereby represents that he has inspected the location or locations of the Work <br />and has satisfied himself as to the condition thereof, including subsoil conditions, and that the <br />Contract Price as set forth herein is just and reasonable compensation for all Work, including all <br />foreseen or unforeseeable risks, hazards, and difficulties in connection therewith. <br />4.5 The Engineer will furnish and set stakes as may be necessary for the Contractor in order that <br />the Contractor may construct the Work to the proper grade and alignment. <br />4.6 The Contractor shall carefully preserve benchmarks, reference points and stakes and, in case <br />of willful or careless destruction, he shall be charged with the resulting expense and shall be <br />responsible for any mistakes that may be caused by their unnecessary loss or disturbance. <br />4.7 The Engineer shall furnish such survey lines and grades as may be necessary for the proper <br />control of the Work; but this shall not relieve the Contractor of responsibility for making careful and <br />accurate measurements and for constructing the Work accurately to the lines furnished by the <br />Engineer. The Contractor shall give the Engineer reasonable notice of his requirements for such <br />survey lines and grade as the Contractor may require. <br />4.8 The Contractor shall furnish and place, as directed, all necessary guide boards and <br />appurtenances and give such other incidental assistance at the Work site as may be required by the <br />Engineer, for staking out the Work. The Contractor's working operations which interfere with the <br />activities of the Engineer shall be temporarily suspended for such reasonable time as the Engineer <br />may deem necessary. The Contractor shall carefully preserve the points furnished by the Engineer <br />and shall receive no extra compensation for any materials or services furnished by the Contractor <br />incidental to these operations of the Engineer. <br />ARTICLE 5. Ownership and Copies of Documents, Record Documents and Security Thereof <br />5.1 All Specifications, Plans and copies thereof furnished by the Owner, through the Engineer, <br />shall remain the Owner's property. They shall not be used on another project, and, with the exception <br />of those sets which have been signed in connection with the execution of the Agreement, shall be <br />returned to the Owner upon completion of the Project. <br />GC 7 <br />
