Motion by Chairperson HendHksen and seconded by Board Member Terry to add #gA to read "If Osmium Street was i ,reproved and a cai-de-sac constructed, no variance would be requirezL" Motion carried. Motion by Board Member Bawden and seconded by Board Member LaDue to amend the remaining f'mdings as follows: 10) "That such variance is necessary for the preservation of a substantial property right..." 11) "That ff granted, the variance will not grant the Applicant any special privilege.. ," 12) "That if gnmte~ the variance will not be materially detrimental to the purposes..." 13) "That if granted, the variance will not substantially increase thc congestion of public streets .... " Motion carried. Voting Yes: Board Members Bawden, I.mDue, Holland and Thorud. Voting No: Chairperson Hendriksen, Board Members Deemer and Terry. Motion by Board Member Bawden and seconded by Board Member LaDue to adopt Resolution g93-09-169 adopting amended Findings of Fact g0343 relating to a request for a variance to minimum street frontage requirements on PIN 14-32-24-13-0003. Amendment by Board Member Deemer and seconded by Board Member Terry to add a finding to read "That the subject property as described by the PIN or by the parcel under contiguous ownership was under great dispute by the Board." Amendment carrie& Voting Yes: Chairperson Hendriksen, Board Members Deemer, Terry, Bawden, and Holland. Voting No: Board Members LaDue and Thorurt Motion carried. Voting Yes: Board Members Bawden, La.Due, Deemer, Holland, Ten3,, and Tnorud. Voting No: Chairperson Hendriksen. Motion by Chairperson Hendfiksen and seconded by Board Member Terry to deny the issuance of a variance based on Findings of Fact #SA inasmuch as them'is no need for a variance strictly for financial reasons. Motion failed. Voting Yes: Chairperson Henflriksen and Board Members Terry and Deemer. Voting No: Board Members Bawden, Holland, LaDue and Thorud. Motion by Board Member La.Due and seconded by Board Member Bawden to adopt Resolution g93-09-170, as drafted, approving the issuance of a variance and declaring terms of same. Motion carried. Voting Yes: Board Members La.Due, Bawden, Holland, and Thom& Voting No: Chairperson Hendriksen and Board Members Deemer and Terry. (Board Member Terry stated the reason for his negative vote is that the variance is being granted for a monetary hardship which is not a legal reason.)
