Motion by Chairperson HendHksen and seconded by Board Member Terry to add #gA to read "If <br />Osmium Street was i ,reproved and a cai-de-sac constructed, no variance would be requirezL" <br /> <br />Motion carried. Voting Yet: Cha/rperson Hendriksen, Board Members Terry, Deemer, and <br />Thorud. Voting No: Board Members Bawden, Holland, and LaDue. <br /> <br />Motion by Board Member Bawden and seconded by Board Member LaDue to amend the <br />remaining f'mdings as follows: 10) "That such variance is necessary for the preservation of a <br />substantial property right..." 11) "That ff granted, the variance will not grant the Applicant any <br />special privilege.. ," 12) "That if gnmte~ the variance will not be materially detrimental to the <br />purposes..." 13) "That if granted, the variance will not substantially increase thc congestion of <br />public streets .... " <br /> <br />Motion carried. Voting Yes: Board Members Bawden, I.mDue, Holland and Thorud. Voting No: <br />Chairperson Hendriksen, Board Members Deemer and Terry. <br /> <br />Motion by Board Member Bawden and seconded by Board Member LaDue to adopt Resolution <br />g93-09-169 adopting amended Findings of Fact g0343 relating to a request for a variance to <br />minimum street frontage requirements on PIN 14-32-24-13-0003. <br /> <br />Amendment by Board Member Deemer and seconded by Board Member Terry to add a finding to <br />read "That the subject property as described by the PIN or by the parcel under contiguous <br />ownership was under great dispute by the Board." <br /> <br />Amendment carrie& Voting Yes: Chairperson Hendriksen, Board Members Deemer, Terry, <br />Bawden, and Holland. Voting No: Board Members LaDue and Thorurt <br /> <br />Motion carried. Voting Yes: Board Members Bawden, La.Due, Deemer, Holland, Ten3,, and <br />Tnorud. Voting No: Chairperson Hendriksen. <br /> <br />Motion by Chairperson Hendfiksen and seconded by Board Member Terry to deny the issuance of <br />a variance based on Findings of Fact #SA inasmuch as them'is no need for a variance strictly for <br />financial reasons. <br /> <br />Motion failed. Voting Yes: Chairperson Henflriksen and Board Members Terry and Deemer. <br />Voting No: Board Members Bawden, Holland, LaDue and Thorud. <br /> <br />Motion by Board Member La.Due and seconded by Board Member Bawden to adopt Resolution <br />g93-09-170, as drafted, approving the issuance of a variance and declaring terms of same. <br /> <br />Motion carried. Voting Yes: Board Members La.Due, Bawden, Holland, and Thom& Voting No: <br />Chairperson Hendriksen and Board Members Deemer and Terry.
