! <br />! <br /> <br />Councilmember ~ <br /> ? <br /> <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION #94-02- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A TEMPORARY <br />CONDITIONAL USE PERMIT FOR THE ESTABLISHMENT AND OPERATION <br />OF AN ALTI~RNATE FUEL SUPPLY TEST DEMONSTRATION FACILITY, <br />BASED ON F ,.I~qDINGS OF FACT # AND DECLARING TERMS OF SAME. <br /> WHERE[AS, Kaltec of Minnesota, Inc. has properly applied for a temporary conditional <br />use permit on Ne~- property generally known as 14730 Sunfish Lake Blvd. N.W. and legally <br />described as follows: <br /> <br /> The South one-half of the Southeast Quarter of Section 22, Townstfip 32, Range 25, <br /> Anoka Ctunty, Minnesota. <br /> <br /> ("Site) an& <br /> WHERE~kS, the Planning met on February 1, 1994 and conducted a public hearing and <br />recommended Ci~ Council approval of the requesu <br /> <br /> NOW TtffEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAh~ISEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Term. T~s permit shall expire on February 8, 1995. All structures, et]uipment, supplies, <br />materials ~md operations residue shall be removed from the Site by said 'expiration date. in <br />the event ~altec fails to comply with the terms of this CUP, the CiD' ma3', upon seven (7) <br />days' writ[en notice, enter onto the propen3, and perform all such obligations, the costs of <br />wkich shall be Ix)me bv Kaitec or, in default thereof, by its surer3.,. <br />Site Development. The development and operatibn of the facility shall be specifically <br />]~mited to~ that described in Kaltec's application and description dated Janum-'y 11, 1994, <br />attached h~reto as Exh/bit "A", together with site plans attached thereto. <br />Noise an~l Odor. Noises emanating from the site and operations shall be in compliance <br />with and j'egulated by the State of Minnesota Pollution Control Standards, Minnesota <br />Re~malario/as MPC, as mended except as modified herein by CiD' requirements. Upon any <br />legirirnate~and substantiated complaint of noise or odor received by the City, Kaltec shall be <br />notified atad will have twenty-four (24) hours to put a corrective action plan in place and <br />seven (7) '(~tays to remedy the problem. <br /> <br />Hours oL'Operation. The hours of operation of the test fac[IiB, shall be perm&ted at 24 <br />hours per [da3'. <br />Control Of Operations. Operations must be conducted so as to minimize noise, safety, <br />odor, visu~ impacts or other nuisance concerns to adjacent residential properties. <br />On-Site Fire Protection. Kaltec shall be responsible for any fire suppression costs <br />required ai the facility. <br />Traffic Truck traffic shall utilize U.S. IqJghway #10 and Sunfish Lake Boulevard N.W. <br />(County ~oad 57) exclusively when u-aveling to and from the faciliB,. <br />Equipment.
