<br />Water Quality. Drainage from the facility shall be directed to ~_n existing sedimentation
<br />basin approximately 150 feet north of the test facility.
<br />
<br />Security. Site security shall be provided by an existing fence and gate.
<br />
<br />Closure Due to CUP Revocation, Other Circumstances. In the event this CUP
<br />is revoked pursuant to the terms herein or Kahec pprematurety closes operation of the
<br />faciliD, for an), reason, including, but without hmitation, order of the court or other agency
<br />of competent jurisdiction, bankruptcy, insolvency, or abandonment, Kahec shall
<br />immediately proceed to remove all structures and equipment from the site. In the event
<br />Kahec fails to comply with the terms of this CUP, the City ma),, upon 30 days' v,~tten
<br />notice, enter on to the property and perform all such obligations, the costs of which shall be
<br />borne by K. altec or, in default thereof, by its surety.
<br />
<br />Building Permits. No construction or placement of any structures shall commence prior
<br />to the issuance of the apphcable building permit by the C{ty Building Official.
<br />
<br />Scope and Conduct of Operations. The operations permitted by this CUP may be
<br />performed on the Subject lh'openy in conformance with existing statutory and regutato~
<br />authority and requirements of the City, Anoka Count>,, Minnesota, and the Minnesota
<br />Pollution Control Agency ("MPCA").
<br />
<br />Financial Assurance. Kaltec shall submit financial assurances as follows:
<br />(a) Charges and Fees. Kaltec agrees to pay to the City upon the issuance of this CUP,
<br /> a fee in an amount sufficient to reimburse the C/ty for engineering, legal and
<br /> admin/smarive expenses reasonably incurred during the consideration and development
<br /> of this CUP. Kaltec shall reimburse the City for all administrative fees incurred by the
<br /> City in connection with inspection of the operation and administration of this CLIP.
<br /> in the event the CiD' incurs additional reasonable costs occasioned solely by the
<br /> presence of this use within the CiD' for personnel n~aining, specialized equipment, risk
<br /> insurance or increased costs for providing f~e deparn-nent services, Kahec a~ees to
<br /> reimburse the CiD' at cost upon presentation of supporting documents and invoices
<br /> consistent with applicable taw.
<br />(b) Liability Insurance and Liability Indemnification. Kahec shall secure and
<br /> maintain insurance from an insttm_nce company acceptable to the City and authorized to
<br /> ~mite casualty insurance in the State of Minnesota which will protect Kaltec, its agents
<br /> and employees, and the CiD, from claims for bodily in.iuD,, death or property damage
<br /> which may arise from the operations on the Site. Kahec shall file a certificate of
<br /> insurance or a certified cop}, of the insurance policy with the CiLv. Such insurance
<br /> policy shall contain a clause providing that it shall not be cancelled by the insurance
<br /> company without thirt3.' (30) days' written notice to the Ciu, of intention to cancel. The
<br /> following coverages shall be provided in mounts not less than those specified:
