The violation of any of the material t~rms of this CUP is grounds for suspension or revocation hereof consistent with applicable~law. Furthermore, the City specifica/ly reserves the right to amend, suspend or revoke thi} CUP consistent with applicable law as reasonably required to protect the public health, s~ety and welfare, and the environment. Specifically, but without limiting the foregoing, lthe City. may amend, suspend or revoke this CUP consistent w/th applicable taw if the Cie/[Council reasonably determines that continued operation of the faciiiD, places the public heal)th, safety or welfare or the environment in jeopardy or creates a public nuisance due to odors, noise or other nuisance factors. Violation!. of Conditions. If Kaltec or its successors or assigns violates any mater/al term or ct.Ildition imposed by this CUP, it may be revoked and terminated consistent with applicable.[- law. Without limiting the foregoing, the violation of any statute, regulation, ordinance~or permit condition imposed by lawful governmental authority and governing or~eration~ on the Site is g'rounds for revocation and termination of this CUP consistent vbith applicable law. The change, alteration or amendment of any such statute, regulation, ordinance ~or permit condition by an)' governmental authority other than the CiD' shall nor excuse I4.~.tec from compliance with stat-utes, regulations, ordinances or CUP conditions in effect on mhe date of the original issuance of this permit unless compliance is waived or excused b2~ the CID'. Violation ~a Misdemeanor. Violation of any of the provisions of this CUP is declared to be a violation in accordance with § 1.02.02 ~ubd.. 1 of the Ramsey Cirv Code. Nonassigr~abilit~' of CUP. Any rights conferred on Kaltec by this CLIP are personal to Kaltec. ~The City is issuing this CLIP on the basis of the credit and reputation of Kaltec. Kaltec shall no~ assign or transfer this CUP without f~rst obtaining approval of the City which ma~ allow or disallow such transfer in its absolute and sole discretion. In the event of rransfer~ the CUP shall apply to Kaltec successors and assigns. In the event the CiD' declines f.tr any reason to allow the transfer of this CUP, Kaltec shall either continue with operations! in full compliance with the terms of this CUP or terminate operations at its option. ~ On-site Inspection.
