That the addition contains its own kitchen, living room, bedroom, and bathroom, all of <br />which are separated from the man living quarters by an atrium door, and its own furnace, <br />water heater and gas meter, and is therefore considered to be an accessoo, apartment by <br />City Staff. <br /> <br />10. <br /> <br />That the Applicant has stated that the accessou, apartment has been utilized as such ever <br />since it was constructed in the 1970's and the Applicant continued this use when taking <br />ownership of the dwelling unit in 1991. <br /> <br />11. <br /> <br />That CitT Staff has determined that the homeowner responsible for constructing the <br />accesso~ apartment in the 1970's never properly obtained a conditional use permit in <br />accordance with City Code and therefore the accessory apartment is considered illegal non- <br />conforming. <br /> <br />1'3 <br /> <br />That the main living quarters and accessoQ' apartment were damaged by £n-e in 1993 and <br />upon inspection by City Staff, the Applicant was informed that a conditional use permit <br />must be obtained to bring the accessory apa.rrment into compliance with City Code. <br /> <br />13. <br /> <br />That the Applicant has subrmtted a petition signed by four (4) neighboring residents <br />indicating no objection to the added living quarters. <br /> <br />14.
