Councilmember ~ <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION ~94-02. <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION <br />ON THE PROPERTY GENERALLY KNOWN AS 14450 BOWERS DRIVE N.W. <br /> <br />HERE~S, Robert and Susan Bowman, hereinafter referred to as "Applicants", have <br />properl,, applied ~r a Conditional U se Permit for a Home Occupation to establish and operate an <br />electrode automo~bile equipment repair facility on the property generally 'known as 14450 Bowers <br />Drive N.W. and lagally described as follows: <br /> Lot 32, BOWERS MISSISSIPPI ACRES, Anoka Count),, Minnesota. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the A~pplicant appeared before the Planning and Zoning Commission for a public <br />hearing p~suant to Section 9.03.~4 (Conditional Usc Pcrrrfits) and Section 9.11.04 (Home <br />Occupations) of the Ramsey Cit3 Code on February. 1, 1994 and that said public hearing <br />was properly advertised and that the minutes of sa.id public hearing are hereby incorporated <br />as a part o~ese fundings by reference. <br /> <br />That the sgbject property is zoned R-1 Rural Residential and is approximately .8 acres in <br />size. <br /> <br />10. <br /> <br />11. <br /> <br />'I'nat commercial businesses are not a permitted use in the R-1 Rural Resident/al District. <br />That the stlbject property is surrounded by R-1 Rural Resident/al zorfing. <br /> <br />That the Apphcant has prov/ded documentation to support that the home occupation will be <br />conducted ~.~thin the principal sn-ucrure on the properD., and that the area set aside for the <br />home occqlpation is 1,118 square feel which exceeds the maximum area (744 square feet) <br />allowed fora home occupation in this size structure by 50%. This is not in conformance <br />with SectiOn 9.11.04 G-'Iome Occupations) of the Ram~ey CiD' Code. <br /> <br />That mor~ than one room will be utilized for the conddtional use which is not in <br />conformani::e with Section 9.11.04 of the Ramsey City. Code. <br /> <br />That the Applicant will reside at the location of the proposed home occupation. <br />That the A~plicant has stated that the home occupation will not include any employment of <br />persons no! residing in the private dwelling in the performance of the home occupation. <br />That the Al~plicant provides for storage needs in the attached garage and there is no exterior <br />storage of ~usiness equipment and materials <br /> <br />Tiuat the Proposed use will/wiI1 not be unduly dangerous or otherwise den/mental to <br />ne~_hbonng resmences. <br /> <br />That the pi~oposed use will/will not substantially adversely imraY- the use, enjoyment or <br />market valtae of an), surroun~ng proper'q,. <br /> <br /> <br />
