Councilmember ~ introduced the following resolution and moved for its <br />adoption: <br /> ~ RESOLUTION #94-03- <br /> <br /> A RESOL.I~_ION ADOPTING FINDINGS OF FACT # RELATING TO <br /> WILLIAM ~UBATS' REQUEST FOR A COND1TIONXL'-DSE PERMIT TO <br /> ESTABLISH AND OPERATE A SELF-SERVICE STORAGE FACILITY IN THE <br /> , B-3 HIGHWAY BUSINESS DISTRICT <br /> <br /> WHERE~S, William Dubats, hereinafter referred to as "Applicant", has properly applied <br />for a Condifion~ Use Permit to establish and operate a self-service storage facility in the B-3 <br />Highway Busine$ District on the property legally described as follows: <br /> <br /> Lot 3, Block 3, RIVERSIDE WEST, Anoka County, Minnesota <br /> r <br /> <br /> "the SubjeCt Property" <br /> <br /> NOW T~. EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Sectioig.03.04 of the Ramsey City Code on March 3, 1994, and that the public hearing <br />was propei'ly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />That the slabject property is approximately 50,000 square feet or 1.15 acres in size. <br />That the st~bject property is zoned B-3 Highway Business. <br /> <br />That the adjacent properties to the south and west are zoned R-1 Urban Residential and <br />Park; and ihe properties to the north and east are also zoned B-3 Highway Business. <br /> <br />o <br /> <br />That the subject property is located within the Critical River Overlay/>/strict. <br /> <br />That according to Ramsey City Code Section 9.20.23 (B-3 Highway Business), self- <br />service stage facilities are not a permitted use in that district. <br /> <br />That the Applicant also owns and operates self-service storage facilities on Lots 1 and 2, <br />Block 3, Riverside West, for which conditional use permits were granted in 1986 and <br />1987. <br /> <br />That the Applicant is proposing to construct three (3) self-service storage facilities on the <br />subject pWpeny, two (2) of which are proposed to be 6,800 square feet each in size and the <br />third stma'ure is proposed to be 5,100 square feet in size, for a total of 18,700 square feet. <br /> <br />That Sec~on 9.21.07 (Critical River Overlay District Development Standards) of the City <br />Code resfficts the impervious surface area to 30% of the lot or 15,000 square feet in this <br />case. -- <br /> <br />10. <br /> <br />11. <br /> <br />That according to the site plan submitted dated February 2, 1994, Revision February 25, <br />1994 C, approximately 90% of the subject property wilt be developed with an imperv/ous <br />surface area; this exceeds the 30% restriction established by Section 9.21.07 of the City <br />Code. <br /> <br />That the Applicant has properly applied for a variance to Section 9.21.07 (Critical River <br />Overlay District Development Standards). <br /> <br />12. <br /> <br />That in 19,86, a variance was granted for Lot 2, which is also in the Critical River Overlay <br />Disa-ict, tO be developed with an impervious surface area measuring 85% of the lot. <br /> <br /> <br />
