Pending <br />Pending <br /> <br />Complete <br /> <br />1~14/93 <br />1~14/93 <br /> <br />3/,17/94 <br /> <br />Monthly Status Report <br /> <br />Execute Resolution ~t93-12-295 (Beyer~immerman/All) approving <br />the request for. a L-~P, as amended, from IPS based upon the <br />Findings of Fact <br /> <br />Council voted that the "fine-tuning" of the indemnification <br />agreement for the IPS Conditional Use Permit should be done by <br />the City Attorney and.the Finance Officer. <br /> <br />Findings of Fact - Bill Dubats' (Lakeview Enterprise, Inc.) request <br />for a variance from side yard setback requirements and impervious <br />surface area restrictions: The Board of Adjusmaent approved 1-8, <br />and 10-I 1, and directed Staff to amend the following: (9) "... and <br />thc Applicant has proposed a drainage plan that provides for a <br />detention volume consisting of a water retention and <br />sedimentation system that will limit the surface water <br />discharged from the Subject ProperS. into the existing storm water <br />system to 1.7 cfa, and Apphcant has stated that he will <br />further restrict the surface water discharged from the <br />Subject Property into the existing storm water system to <br />that which would normally be expected if the property <br />was developed with 30% impervious, surface area." Add <br />10A to read "That even though minutes reflect there was verbal <br />approval by the Department of Natural Resources for the variance <br />granted in 1986 for Lot 2, Block 3, Riverside West, there is no <br />documentation of such." (12) "... is an expansion of the <br />development that has occurred on Lots 1 and 2; and d) City <br />Code requires that in the commercial district all off- <br />street parking, driveways, and maneuvering areas be <br />paved and curbed." Add #12A to read "That the proposed <br />coverage of the lot by buildings is approximately 30% which would <br />be permitted by the B-3 Highway Business District." (13) "That <br />the special conditions causing fl~e undue hardship do not result <br />from the actions of the Applicant." .(14) '"l'~nat such variance is <br />necessary for the preservation of a substantial property right..." <br />(15) 'q'"nat if granted, the variance will not grant the Applicant any <br />special privilege...' (16) "That if granted, the variance will not' <br />be materially detrimental to the purposes of the Ramsey Zoning <br />Chapter . . ." (17) "That if granted, the variance will not <br />substantially increase the congestion of public streets .... "Add <br />#18 to read "That the Applicant has stated he will submit and <br />implement drainage plans which call for on-site <br />retention/percolation of run-off water for 40% of the impervious <br />surface area and on-site retention/sedimentation of run-off from the <br />remaining 60% impervious surface m-ca with discharge to the <br />municipal storm sewer system restricted to 1.3 cfs, such figure <br />being the estimated flow resulting from a 30% impervious <br />coverage." Also add the wording "secjimentation and sldmmirtg" in <br />#18. Add #19 to-read "That'the Subject Property, by the City <br />Engineer's estimate and the accompanying letters submitted in the <br />publie hearing xvm~ord, is entitled to. a surface water discharge of 1.7 <br />els to the already approved existing City storm water system <br />discharging into the Mississippi River." Add #20 to read "That the <br />Subject Property cannot be put to a reasonable use under the 30% <br />impervious axea restriction considering its present commercial <br />zoning and valuation." Add #21 to read "That in granting this 88% <br />impervious variance, it complies with the intent of the Wild and <br />Scenic River Act and the Critical Area Designation Executive Order <br /> <br /> <br />
