Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #94-05. A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FO~t A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION ON THE PROPERTY GENERALLY KNOWN AS 17310 ST. FRANCIS BLVD. N.W. ~ WHEREAS, Jeffrey Lorge and Julie Lorge, husband and wife, hereinafter referred to as "Applicants", ha~e properly applied for a Conditional Use Permit for a Home Occupation-to establish and operate a one-chair beauty salon On the property generally known as 17310 St. Francis Blvd. N.W. and legally described as follows: Lot 13, Auditors Subdivision #27, except road subject to easement of record; Anoka County, S~ate of Minnesota. CITY 1. (the "Subject Property") NOW T~IEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE OF RAI~!r SEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicants appeared before the Planning and Zoning Commission for a public hearing p4rsuant to Section 9.03.04 (Conditional Use Permits) and Section 9.11.04 (Home Occupano~ns) of the Ramsey C~ty Code on May 3, 1994 and that smd pubhc heann~, was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of thase findin~,s by reference. That the s, ubject property is zoned R-1 Rural Residential and is approximately 1 acre in size. That beauty salons are not a permitted use in the R-1 Rural Residential District. That the s~Ubject property is surrounded by R-1 Rural Residential zoning and a residential Planned Unit Development. That the Applicant has provided documentation to support that the home occupation will be conducted within the private dwelling on the property and that the area set aside for the home occupation does not exceed 20% of the total floor area of the private dwelling. That the Applicant will reside at the location of the proposed home occupation. That the Applicant has stated that the home occupation will not include any employment of persons not residing in the private dwelling in the performance of the home occupation. That the A, pplicant has stated that there will be no exterior storage of business equipment and materials. .9. 10. That thereiare other similar permitted conditional uses in .the R-1 Rural Residential District. That the Proposed use will/will not be unduly dangerous or otherwise detrimental to neighborifig residences.
