This will be on the August Planning Commission <br />agenda. <br /> <br />Execute Resolution #93-12-294 (Zin'~merman/Beyer/all) accepting <br />the Findings of Fact #0350, as amended, relating to IPS request for <br />a CUP to establish and operate a compost facility. <br /> <br />Execute Resolution #93-12-295 (Beyer/Zimmerman/All) approving <br />the request for a CUP, as amended, from IPS based upon the <br />Findings of Fact #0350. <br /> <br />Council voted that the "fine-tuning" of the indemnification <br />agreement for the IPS Conditional Use Permit should be done by <br />the City Attorney and the Finance Officer. <br /> <br />The Board of Adjustment directed you to put a case on the Planning <br />Commission agenda regarding total accessory space allotment as it <br />pertains to non-contiguous parcels of record; Obtain the City <br />Attorney's opinion as to whether the total accessory space allotment <br />on a non-contiguous parcel should be based on the portion of the lot <br />where the principal structure is located or on all portions making up <br />the parcel of record. <br /> <br />The Board of Adjustment directed Staff and legal counsel to <br />investigate the possibility of providing an equal fight of appeal to <br />both the applicant and those opposing the ~anting of a variance. It <br />was ',dso suggested that perhaps the City Council should withdraw <br />the applicant's fight of appeal. <br />Council asked that the City Attorney and Staff review ordinance to <br />make sure City Code is as complete in its language as the State <br />Statutes with regard to Metes and Bounds subdivisions. <br /> <br />Execute Resolution #94-04-076 (Hardin/Peterson/Absent <br />Gilbertson and Beyer) adopting Findings of Fact #0360 relating to <br />Sidney Nyhusmoen's request for a CUP to grade and export soils. <br /> <br /> <br />
