Councilmember <br />adoption: <br /> <br />introduced the following resoltition and moved for its <br /> <br /> RESOLUTION #94-08- <br /> <br />A RESOLUTI~ON ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FR~OM GORDON HICKS FOR A CONDITIONAL USE PERMIT TO <br />STORE COMMERCIAL EQUIPMENT IN AN R-1 RURAL RESIDENTIAL <br />DISTRICT <br /> <br /> WHERI~.AS, the City of Ramsey received an application from Gordon Hicks for a <br />conditional use l~rmit to store commercial equipment in the R-1 Rural Residential District on the <br />property generality known as 16340 Nowthen Blvd. N.W. and legally described as follows: <br /> <br /> That parti of the East 1/2 of the Northwest 1/4 of Section 15, Township 32, Range 25, <br /> described, as follows: Beginning at a point in the East line of said Northwest 1/4 distant <br /> 1695 feetlNorth of the Southeast comer of said Northwest 1/4; thence West at fight angles <br /> to said East line of the Northwest 1/4, a distance of 288 feet; thence at a fight angle South a <br /> distance df 150 feet; thence at a fight angle West to the intersection with the East line of the <br /> West 30fffeet of said East 1/2 of the Northwest 1/4; thence Northerly, along said East line <br /> of the Wdst 300 feet of the East 1/2 of the Northwest 1/4 to the intersection with the South <br /> line of th~ North 800 feet of said East 1/2 of the Northwest 1/4; thence Easterly along said <br /> South lin{ of the Noah 800 feet of the East 1/2 of the Northwest 1/4 to the East line of said <br /> Northwest 1/4; thence Southerly along said East line of Northwest 1/4 to the point of <br /> beginning. Subject to highway easement for County Road No. 5 over the East 75 feet <br /> thereof. <br /> <br /> Subject to restrictions, reservations and easements of record, if any. <br /> <br /> (the "Subject Property") <br /> : <br /> <br />NOW THERE~FORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF R!MSEY, ANOKA COUNTY, STATE OF MINNESOTA that the <br />findings of fact relating to the request are determined to be as follows: <br /> <br />That Got[don Hicks, hereinafter referred to as "Applicant", has properly applied for a <br />condifiorial use permit to store a commercial vehicles and equipment in the R-1 Rural <br />Residenti[1 District. <br /> <br />o <br /> <br />That the ~pplication is pursuant to a court order resulting from a zoning violation of a <br />commercial business operation in a residentially zoned district. <br /> <br />That the zoning violation was initiated by a complaint to City Staff of a commercial asphalt <br />operation!being conducted on the subject property. <br /> <br />That the ~pplicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 (Conditional Use Permits) on August 2, 1994 and that <br />said public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />That the lubject property is zoned R-1 Rural Residential and is approximately 9.7 acres in <br />size. <br /> <br />6.
