Monthly Status Report <br /> <br />Pending/ <br />Goodrich <br /> <br />Pending/ <br />Goodrich <br /> <br />Pending/ <br />Goodrich <br /> <br />Pending <br /> <br />Pending <br /> <br />3/17/94 <br /> <br />3/17/94 <br /> <br />4/12/94 <br /> <br />5/24/~4 <br /> <br />7~5/94 <br /> <br />The Board of Adjustment directed you to put a case on the Planning <br />Commission agenda regarding total accessory space allotment as it <br />pertains to non-contiguous parcels of record; Obtain the City <br />Attorney's opinion as to whether the total accessory space allotment <br />on a non-contiguous parcel should be based on the portion of the lot <br />where the principal structure is located or on all portions making up <br />the parcel of record. <br /> <br />The Board of Adjustment directed Staff and legal counsel to <br />investigate the possibility of providing an equal right of appeal to <br />both the applicant and those opposing the granting of a variance. It <br />was also suggested that perhaps the City Council should withdraw <br />the applicant's right of appeal. <br /> <br />Council asked that the City Attorney and Staff review ordinance to <br />make sure City Code is as complete in its language as the State <br />Statutes with regard to Metes and Bounds subdivisions. <br /> <br />Council suggested that you call the City of Maple Grove to see if <br />there is anything (complaints or violations) on file for Diane <br />Dempsey. <br /> <br />Findings of Fact - Rebecca Jackson's request for a CUP to maintain <br />an accessory apartment: The Planning Commission approved 1-7, <br />and directed Staff to amend the following: (8) "That the proposed <br />use will not adversely impact traffic in the area. (9) "That the <br />proposed use will not be dangerous or detrimental to persons <br />residing or working in the vicinity." (10) "That the proposed use <br />will not substantially or adversely impair the use, enjoyment or <br />market value of surrounding properties." (11) "That the proposed <br />use will be maintained in order to be harmonious in appearance <br />with the existing and intended character of the R- 1 Rural Residential <br />District." (12) "That the proposed use will be adequately served <br />by essential public services." (13) "That the proposed use will <br />not create excessive additional requirements at public cost for <br />public facilities and services." Add a finding to read "That at least <br />one neighbor opposes the granting of this permit." Add a finding to <br />read "That based on the comments at the public hearing and the <br />discussion of the Planning Commission on July 5, the consensus of <br />the Planning Commission was that the type of permit issued, if it is <br />issued, should be interim use rather than conditional use so that the <br />permit may expire concurrent with the applicant's ownership of'the <br />property." The Planning Commission voted to recommend that <br />City Council adopt the amended findings of fact relating to Rebecca <br />Jackson's request for a conditional use permit for an accessory <br />apartment. Forward to City Council. Council tabled until <br />there is an ordinance in place. <br /> <br /> <br />
