CASE #2 <br /> <br /> REVIEW SUBDIVISION ORDINANCES <br />By: Mark Boos, Parks/Utilities Supervisor <br /> <br />Background: <br /> <br />At the May 12, 1994 Park and Recreation Commission meeting, the Commission directed <br />Staff to place the City's subdivision ordinance on the June agenda for review. <br /> <br />Recently City Council mended the subdivision ordinances, including "house cleaning" and <br />changing the bash contribution rate to one that is set annually by resolution. (The cash <br />contribution rate for densities of less than .3 units per acre is $450 and for dwelling unit <br />densities greater than .31, the cash rate is $700. <br /> <br />This case is not intended to propose changes to the ordinance or the contribution rates. <br />However, lit6ral interpretation of Subdivision 12, (9.50.37) Application to Minor <br />Subdivision may lead a reader to believe that the City cannot request land for park <br />dedication outside of the new lots being created. Subdivision 12 reads: <br /> <br />"In tho event of a minor subdivision, the provisions of this Chapter shall <br />apply ~to the new lots being created rather than the gross area being <br />subdivided." <br /> <br />Staff recomm°nds the Commission request an ordinance amendment to clarify Subdivision <br />12. A suggestion would be: <br /> <br /> "In tho event of a minor subdivision, the provisions of this Chapter shall <br /> apply [to the new lots being created rather than the gross area being <br /> subdivided with the exception of land dedication where the gross area <br /> subdivided can be considered for park dedication:" <br /> <br />The process for amending an ordinance would be for the Planning Commission to act on <br />the proposed ahanges and to hold a public hearing.
