CASE #2 REVIEW SUBDIVISION ORDINANCES By: Mark Boos, Parks/Utilities Supervisor Background: At the May 12, 1994 Park and Recreation Commission meeting, the Commission directed Staff to place the City's subdivision ordinance on the June agenda for review. Recently City Council mended the subdivision ordinances, including "house cleaning" and changing the bash contribution rate to one that is set annually by resolution. (The cash contribution rate for densities of less than .3 units per acre is $450 and for dwelling unit densities greater than .31, the cash rate is $700. This case is not intended to propose changes to the ordinance or the contribution rates. However, lit6ral interpretation of Subdivision 12, (9.50.37) Application to Minor Subdivision may lead a reader to believe that the City cannot request land for park dedication outside of the new lots being created. Subdivision 12 reads: "In tho event of a minor subdivision, the provisions of this Chapter shall apply ~to the new lots being created rather than the gross area being subdivided." Staff recomm°nds the Commission request an ordinance amendment to clarify Subdivision 12. A suggestion would be: "In tho event of a minor subdivision, the provisions of this Chapter shall apply [to the new lots being created rather than the gross area being subdivided with the exception of land dedication where the gross area subdivided can be considered for park dedication:" The process for amending an ordinance would be for the Planning Commission to act on the proposed ahanges and to hold a public hearing. The City Council would then address the issue. Staff Recommendation: Staff recommonds reviewing City Code 9.50.37 and pursuing an amendment to clarify the verbiage in Subdivision 12.
