affect at the time final plat approval is granted. "Fair Market Value", for purposes of this <br />subdivision, 1~811 b¢ determined at the time of approval of the final plat in accordance with <br />the following: <br /> <br />The City Park and Recreation Commission and subdivider may agree <br />upon a recommendation to thc City Council as to thc fair market value <br />based upon recommendation by the Assessor. <br /> <br />The City Council after reviewing the Park and Recreation <br />Commission's recommendation, may agree with the subdivider as to <br />me fair market value. If agreement is not reached in this manner, then <br />fair market value shall be determined in accordance with thc following: <br /> <br />The fair market value as determined by the City Council based <br />upon appraisals, accepted purchase agreements, comparable <br />market transactions or other pertinent records as determined by <br />the City Council. <br /> <br />The City Council, upon review and recommendation of the Park and Recreation <br />Commission shall annually determine by resolution the park and dedication fee per <br />residential unit. <br /> <br />If, at the option of the City Council it is determined that a cash dedication shall be made, <br />said cash shall be placed in a special fund for Parks and Recreation use and deposited by <br />the developer with the City prior to final plat approval. <br /> <br /> Subd. 7. Combination of land dedication and cash payment. <br />In appropriate plats, a comb/nation of land and cash may be required by the City Council. <br />In the event a combination of land and cash is required, the amount of land to be deckicaw..d <br />shall be credited against the total park dedication requirement and the remaining cash <br />contribution shall be based on the greater of the specified.cash con~bution per dwelling <br />unit or the fair market value of the land. When determining the cash contribution for the <br />remaining acreage, the overall density of the plat shall be the basis for determining the <br />potential n-tuber of dwelling units per acre. <br /> <br /> Subd. 8. Scenic easements. In appropriate plats, as determined by <br />agreement between the City Council and the subdivider, the subdivider may dedicate to the <br />public a scenic easement in comb/nation w/th the requirements of §9.50.37 Subd. 2 and 3 <br />above or, ff the subdivider and City Council agree, the scenic easement dedication may be <br />in lieu of up to 25% of the require~nents in §9.50.37 Subd. 2 and 3 above. <br /> <br /> Subd. P. Required improvements. Subdividers shall be responsible <br />for m~ldng certain irnprovemenrs to the parkland they dedicate within their development for <br />park, playground and public open space purposes as follows: <br /> <br />Provide finish grading and turf establishment for al1 park, playground, <br />trail and public open spaces and provide landscape screening in <br />accordance w/th City PoI/cy. <br /> <br />Consumer and pave rrails which are identified by the City as accessible <br />bikeway/walkway trails in accordance with City Standards <br />concurrently with the roads in their developments (i.e., grading w/th <br />site grading and paving with street or parking lot paving). Grade and <br />provide appropriate surfacing, as approved by the Park and Recreation <br />Commission, of trails identified by the City as horse or wilderness <br />trails. Park dedication credit will be given for construction of the <br /> <br /> <br />
