inspe~on, ~all be included in the owner or subdividers contract with the City pursuant to <br />§9.50.$0 Su/.~. 7, and the appropriate security in the form of cash, letter of credit or bond <br />shall be deposited with the City as required by that section. <br /> <br /> ' Subd. 7. Performance contract. Prior to the installation of any <br />required imp~vements by a subdivider and prior to Council approval of the final plat, the <br />subdivider shall enter into a contract with the City, which contract shall require the <br />subdivider t~ construct said improvements at the sole expense of the subdivider and in <br />a~cordance With City approved constructions plans and specifications and all applicable <br />City stan. d~r~s and ordinances. Said contract shall provide for the supervision of the <br />construcnon ~y the City Engineer and shall require that the City be reimbursed for all costs <br />incurred by the City for engineering and legal fees and other expenses in connection with <br />the rn~kqug o~ such improvements. The performance of said contract shall be financially <br />secured by $ cash escrow deposit or financial surety as hereinafter set forth. No <br />performance .~ontract or financial security shall be required for any improvement which is <br />not a requirement for approval of the final plat. The contract shall also provide that the <br />subdivider gi~e a one year warranty and guarantee to the City from date of acceptance by <br />the City on ~ improvements consmucted on behalf of or dedicated to the City. <br /> <br /> Subd. 8. Construction Plans (All Development Areas). <br />Construction: plans and specification for the required improvements conforming in all <br />respects with.~the code and ordinances of the City shall be prepared at the expense of the <br />subdivider b~a professional engineer registered by the State of Minnesota. Such plans and <br />specification~ shall be approved by the City Engineer and shall become a pan of the <br />performance ~:on~act. Two prints of said plans and specifications shall be filed with the <br />City Adrn~ui.~ator or desi~ated representative. <br /> <br /> Subd.9. Inspection (Ail Development Areas). All required <br />improvemen~ shall be inspected during the course of construction by the City Engineer and <br />acceptance o~said improvements by the City shall require the prior written certification by <br />the City Engineer that said improvements have been constructed in compliance with the <br />plans and sp~ifications. <br /> ~ Snbd. 10. Prior Improvements. Improvements which have been <br />completed prior to application for final plat approval or execution of the perform,ncc <br />contract shalI~ be accepted as equivalent improvements provided the City Engineer shall <br />certify in wri ~t[ng that all smd improvements conform to City standards. <br /> ~ Subd.ll. Construction by City. The City shall have the right to <br />install such ef the required improvements as it may elect and upon such terms and <br />conditions as it may deem appropriate under the circumstances. <br /> <br /> Subd.12. Warranty. The City shall, where appropriate, require a <br />subdivider su[pmission of a warranty/maintenance bond in the amount equal to the original <br />cost of the iml~rovements which shall be in force for one yem' following the final acceptance <br />of any requ~ed improvements and shall guarantee satisfactory performance of s~id <br />improvement~. <br /> <br /> Subd.13. As Built Plans. Upon completion of installation of all <br />required imprC~vements, the subdivider shall file with the City Administrator or designated <br />representativ~ a tracing and two copies of plans and specifications showing all <br />improvement~ as finally constructed and installed. Such as-built drawings shall be certified <br />to be true an~ accurate by the registered engineer responsible for the installation of the <br />improvements. <br /> <br />9.50.57 Sidewalks and pedestrian ways. <br /> <br /> <br />
