CASE # 2

TERM LIMIT FOR THE POSITION OF ASSISTANT CHIEF
By: Ryan Schroeder, City Administrator and
Kay McAioney, Administrative Services Manager

Background:

On August 17, 1994 the Fire Board met to discuss the hiring process for the position of
Fire Chief. :During the discussion there was concern raised from the Fire Department
regarding the lack of a term limit for the position of Assistant Fire Chief. The Department
felt that there would not be adequate opportunities for members of the fire department if
there were nO term limits for both the Chief and Assistant Chief positions. Staff stated that
if the position were presented in the same manner as in the police department, as a
"temporary work assignment", it would be possible to have the position of Assistant Fire
Chief be a two-year assignment.

Attached in Case #1 is a letter from League of Minnesota Cities Insurance Trust Attorney
Carla Heyl. [Ms. Heyl stated that "it should be made clear to all those involved that these
are in fact tegnporary work assignments for a limited time period and that another person
may be chosen for the next term."

Recommendation:

Staff recomm, ends that the position of Assistant Fire Chief be a two-year temporary work
assignment 6fffecfive January 1, 1995.

Board ActiOn:

Approve the above process and forward the recommendation to the City Council for
approval.

Review Checklist:

City Administrator
Fire Chief
Adminisu'atige Services .Manager
Assistant Fire Chief

FB: 09/14/94
