Ms. Prolik expl&ined the difference is that the original PUD was to be when City sewer and <br /> <br />Mr. Goodrich stated that, if approved, it will become a policy question; whether it becomes <br />a legal question depends on the next applicant's actions, ff the differences were presented <br />in court, the ruling is questionable. <br /> <br />Mr. Dom stated the point is that he is asking for a reduction in density, and that if someone <br />else comes in and can match their project of a PUD with condominium approval and asking <br />for a reduction in density, then it should be granted. <br /> <br />Councitmember Hardin inquired whether The Metropolitan Council would respond if the <br />City outlined this particular case and requested whether approving it would endanger <br />MUSA expansion. <br /> <br />Mr. Schroeder replied that when he contacted The Metropolitan Council he only asked for <br />their comments. He added that he could send them another letter inquiring how this can be <br />approved without endangering MUSA expansion. <br /> <br />Councilmember Beyer noted that there are townhouses on Bunker Lake Boulevard across <br />from Majestic Oaks which is outside the MI_ISA. <br /> <br />Mr. Dom replied that that city does not currently have any requests for MUSA expansion, <br />nor do they have any intentions of doing so in the furore. <br /> <br />Mayor Gilbertson expressed regret that the City has to worry about what the Metropolitan <br />Council is going to do to the southern half of Ramsey ff the City approves this request. <br /> <br />Councitmember Peterson inquired if Mr. Dom is going to wait until MUSA has been <br />clarified. <br /> <br />Mr. Dom agreed that he will walt. He stated he only wants to proceed with the process of <br />the public hearing, but he does not want to jeopardize the MUSA. <br /> <br />Mr. Goodrich inquired why Mr. Dom needs sketch plan approval at this time. <br /> <br />Mr. Dom explained he needs sketch plan approval to proceed with the first public hearing. <br />He stated he would like the City to see that the people are not going to be happy with what <br />was agreed to if the condominiums come in instead of townhouses. Again, Mr. Dom <br />agreed that the project would be put on a shelf to see what happens with the MUSA <br />expansion. <br /> <br />Councilmember Zimmerman expressed his concern about jeopardizing the MUSA and <br />stated he would like to see this resolved with the Metropolitan Council before making a <br />decision on the townhouses. <br /> <br />Ms. Frolik mentioned that ultimately <br />approved without sewer and water. <br /> <br />this higher density housing would have to be <br /> <br />Councilmember Peterson suggested Setting guidelines for making exception to the 4 iw40. <br /> <br />The Council inquired of the City Engineer his comments on approving townhouses with <br />septic systems. <br /> <br />City Council/March 8, 1994 <br /> Page 4 of 7 <br /> <br /> <br />
