o <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />That coristruction of the accessory structure in a manner that meets the requirements of <br />Section ,[9.11.02 is prohibited by an excessive front yard setback resulting from the <br />placeme~t of the home, the location of the well, on-site septic system, alternate dminfield <br />area, and would require removal of a substantial amount of mature tree growth and the <br />addition ~f a substantial amount of fill. <br /> <br />That according to Section 9.11.02 (Accessory Uses) of the Ramsey City Code, the subject <br />property!is entitled to a total of 3,664 square feet of garage and accessory building space <br />based on, the size of the contiguous portion of the parcel on which the principal structure is <br />located. <br /> <br />That the total amount of accessory structure space currently existing on the property is 896 <br />square f~et. <br /> <br />That the[Applicant is proposing to construct an accessory structure 1,500 square feet in <br />size, which is in compliance with Section 9.11.02. <br /> <br />That there is a substantial amount of mature tree growth on the subject property that will <br />screen the proposed accessory structure from C.S.A.H. #57. <br /> <br />That the ,Applicant has stated that the variance requested is the minimum vahance which <br />would alleviate the hardship. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to Other properties in the district; namely, that the builder of the home created a 300 <br />foot front yard setback by the placement of the home and the declining topography that <br />surround~ the location of the principal structure. <br /> <br />That the ~pecial conditions causing the undue hardsh/p do not result from the actions of the <br />Applicant. <br /> <br />That such variance is necessary for the preservation of a substantial property fight similar to <br />that possessed by other properties in the R- 1 Rural Residential District, namely the ability <br />to have accessory structures on the subject property in accordance with regulations <br />establish ~1 in City Code. <br /> <br />That if ~anted, the variance will/will not rant the Applicant any special privilege that is <br />denied torother owners of lands, structures or buildings in the same disrr/ct <br /> <br />That if ~anted, the variance will/will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the R-1 Rural Residential District. <br /> <br />That if ~anted, the variance will/will not substantially increase the congestion of public <br />streets, or, increase the danger of fire, or endanger the public safer>,, or substantially impair <br />property 9alues within the neighborhoock <br /> <br />18. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> ' and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the followin~ abstained: <br /> <br /> <br />
