That the Subject Property is not visible from the Mississippi River and the Applicant has <br />proposed a drainage plan that provides for a detention volume consisting of a trench lined <br />with block that will limit the surface water discharged from the Subject Property into the <br />existing storm water system to 1.7 cfs. <br /> <br />10. <br /> <br />That in 1986, the City of Ramsey granted a variance to the impervious surface area <br />requirement for Lot 2, Block 3, Riverside West to be developed with self-service storage <br />facilities at an impervious surface area coverage of 85%. <br /> <br />11. <br /> <br />That the Applicants request for a variance to the impervious surface area has been <br />forwarded to the Department of Natural Resources, the Environmental Quality Board, and <br />the Metropolitan Council for review and comment. <br /> <br />12. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district. Namely: a) the subject property is in the Critical <br />Overlay Diswict and lot development is restricted to 30% of the lot area; b) Lots 1 and 2 <br />were allowed to be developed beyond the 30% impervious surface area limit and with no <br />side yard setbacks; c) the development of the subject property is an expansion of the <br />development that has occurred on Lots 1 and 2. <br /> <br />13. <br /> <br />That the special conditions causing the undue hardship do/do not result fi.om the actions of <br />the Applicant. <br /> <br />14. <br /> <br />That such variance is/is not necessary for the preservation of a substantial property right <br />similar to that possessed by other properties in the B-3 Highway Business District. <br /> <br />That if granted, the variance will/will not grant the Applicant any special privilege that is <br />denied to other owners of lands, structures or buildings in the same district. <br /> <br />t6. <br /> <br />17. <br /> <br />That if granted, the variance will/will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property, in the B-3 Highway Business Dismct. <br /> <br />That if granted, the variance will/wiI1 not substanti~ly increase the congestion of public <br />streets, or increase the danger of fire, or endanger the public safety, or substantially impair <br />property values within the neighborhood. <br /> <br />18. <br /> <br />19. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: , <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the <br />__ day of ., 1994. <br /> <br />ATI'EST: <br /> <br />Chairperson <br /> <br />City Administrator <br /> <br />26, <br /> <br /> <br />
