11. <br /> <br />12. <br /> <br />13. <br /> <br />Hard St rfaced Driveways. Hard surfaced driveways (bituminous or concrete) are a <br />requirerr mt for each lot in the Plat. Said improvement shall be installed by the building <br />permit a lplicant or the homeowner at the time the Certificate of Occupancy is issued or <br />as soon hereafter as possible, weather permitting. In the event this improvement is not <br />timely i~stalled on a lot, the DEVELOPER and/or the DEVELOPER'S assi~ma(s), <br />agrees tt~at the CITY may install said improvement on the lot and specially assess the <br />cost the(e£ore against the lot. The DEVELOPER hereby waives all right to a public <br />hearing ~[nd other statutory rights or City Charter rights granted a property owner relating <br />to specia[ assessments, including the right to appeal the special assessment for installation <br />of the h~d surfaced driveway. In addition., the DEVELOPER grants the CITY a license <br />to enter ~n each lot of the Plat in order' 'to install the improvement described in this <br />paragraph if the same has not been previously constructed. <br /> <br />Street C!eaning. From time to time, the CITY may remove accumulations of soil, earth <br />and debris from the streets resulting from 'the construction of the Plat. It shall be the <br />DEVELOPER'S responsibility to;'lSay the costs associated with this necessary street <br />cleaning.[ Invoices from the CITY to the DEVELOPER for such costs shall be paid <br />within fi~een (15) days of the date of invoice. <br /> <br /> SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in the <br />Plat shall~be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br />structure;,. (b) a Certificate of Survey that contains information required by the CITY has <br />been supL~lied to the City Building Official; and (c) all the financial guarantees required by <br />the CIT~ have been satisfied; and (d) the DEVTELOPER has provided the CITY with a <br />copy of the Lower Rum River Water Management Organization permit and the Minnesota <br />Pollution[Control Agency permit. The CITY reserves the right to suspend all building <br />activities [upon the CITY being notified by an outside agency that the appropriate permit(s) <br />was not c{btained from the applicable agency. Approval of the building foundation requires a <br />certificat~ of elevation signed by a licensed (State of Minnesota), professional land surveyor, <br />verifying[ that the elevation complies with the approved grading plan for each lot. <br />Foundanc~n approvals wall reqmre a certificate of elevatmn verifying that the actual elevation <br />is in comlsliance with the approved grading and drainage plan.. The lowest floor elevation <br />shall be ~ least 2 feet above the 100 year elevation. No occupancy permit for any lot in the <br />Plat shall~be issued until: (a) vehicular access to the lot is provided including the installation <br />of at [eas~ one layer of bituminous surfacing; (b) all utilities are in place, operational and <br />accepted ~y the CITY; (c) the City has been provided with a certificate of ~ading for any <br />lot with ~_ slope flatter than 2%; and (d) boulevard sod and landscape tree, or escrow for <br />same, ha~e been provided. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />-159- <br /> <br /> <br />
