14. Cash Contribution. The Plat is located in the Marble Recreation District. Park dedication requirements shall be satisfied by a cash payment in the amount of Three Thousand Six Hundred Dollars and no cents ($3,600.00) (2 lots x $1,800.00 per lot). The existing homestead is exempt from the park dedication obligation. This payment shall be made to the City, prior to the release of the Final Plat for recording. SECTION' V TRANSPORTATION AND LANDSCAPING 15. Trail Development And Fees. The City, Codncil has enacted a trail development fee in the amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per new lot created. Therefore, a payment in the amount of Nine Hundred Fifty Dollars and no cents ($950.00) (2 lots x $475.00/1o0 is due. The existing homestead is exempt from the Trail Fee obligation. This payment shall b.e made to the City ;prior to the release of the Final Plat for recording. 16. Sidewalk Construction. The CITY is not requiring the construction of sidewalks in this Plat. Tree and Sod Planting Plan. Sodded boulevards, in addition to two (2) yard trees, are a requirement for each lot in the Plat prior to issuance of a Certificate of Occupancy. The DEVELOPER is required to submit a Plan for CITY approval that identifies existing tree growth within the Plat that will be protected during construction, and identifies the location and species of the new plantings. The trees to be protected must be identified on the plan, and the plan must require the installation of 'tree save fences' prior to land clearing or grading. In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER as follows: a) Minimizing the impact of construction on trees in accordance with Minnesota Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135-S). b) Two (2) trees shall be planted on each lot in the Plat. The plantings shall be in accordance with the approved species listed in the Ramsey Tree Book. A minimum of twenty-five percent (25%) of the trees planted in the Plat shall be either deciduous or coniferous. One two-inch diameter deciduous tree, of an approved species, shall be planted at the road frontage of each of the lot in the Plat; the location of the remaining trees to be planted shall be at the discretion of the Builder. For trees intended to be planted between the sidewalk and the street, the specific locations must be staked in advance of planting and approved by the CITY. An escrow in the amount of Six Hundred Dollars ($600.00) shall be collected on the Building Permit for each lot in the Plat to ensure the timely installation of the boulevard sod and trees. Upon verification of the plantings being accomplished, said cash deposit shall be refunded to the Building Permit applicant. Failure of the Builder to comply with the planting requirement within a reasonable time frame following a determination by the CITY that weather conditions are conducive to planting shall give the CITY authori~ to cause the planting, the cost of which shall be charged to the escrow -160-
