14. <br /> <br />Cash Contribution. The Plat is located in the Marble Recreation District. Park <br />dedication requirements shall be satisfied by a cash payment in the amount of Three <br />Thousand Six Hundred Dollars and no cents ($3,600.00) (2 lots x $1,800.00 per lot). The <br />existing homestead is exempt from the park dedication obligation. This payment shall be <br />made to the City, prior to the release of the Final Plat for recording. <br /> <br /> SECTION' V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />15. Trail Development And Fees. The City, Codncil has enacted a trail development fee in the <br /> amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per new lot created. <br /> Therefore, a payment in the amount of Nine Hundred Fifty Dollars and no cents ($950.00) (2 <br /> lots x $475.00/1o0 is due. The existing homestead is exempt from the Trail Fee obligation. <br /> This payment shall b.e made to the City ;prior to the release of the Final Plat for recording. <br /> <br />16. Sidewalk Construction. The CITY is not requiring the construction of sidewalks in this <br /> Plat. <br /> <br />Tree and Sod Planting Plan. Sodded boulevards, in addition to two (2) yard trees, are a <br />requirement for each lot in the Plat prior to issuance of a Certificate of Occupancy. The <br />DEVELOPER is required to submit a Plan for CITY approval that identifies existing tree <br />growth within the Plat that will be protected during construction, and identifies the location <br />and species of the new plantings. The trees to be protected must be identified on the plan, <br />and the plan must require the installation of 'tree save fences' prior to land clearing or <br />grading. In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER as <br />follows: <br /> <br />a) <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135-S). <br /> <br />b) <br /> <br />Two (2) trees shall be planted on each lot in the Plat. The plantings shall be in <br />accordance with the approved species listed in the Ramsey Tree Book. A minimum <br />of twenty-five percent (25%) of the trees planted in the Plat shall be either deciduous <br />or coniferous. One two-inch diameter deciduous tree, of an approved species, shall <br />be planted at the road frontage of each of the lot in the Plat; the location of the <br />remaining trees to be planted shall be at the discretion of the Builder. For trees <br />intended to be planted between the sidewalk and the street, the specific locations <br />must be staked in advance of planting and approved by the CITY. An escrow in the <br />amount of Six Hundred Dollars ($600.00) shall be collected on the Building Permit <br />for each lot in the Plat to ensure the timely installation of the boulevard sod and <br />trees. Upon verification of the plantings being accomplished, said cash deposit shall <br />be refunded to the Building Permit applicant. Failure of the Builder to comply with <br />the planting requirement within a reasonable time frame following a determination <br />by the CITY that weather conditions are conducive to planting shall give the CITY <br />authori~ to cause the planting, the cost of which shall be charged to the escrow <br /> <br />-160- <br /> <br /> <br />
