Golder Associat~ Inc., the City of Ramsey has been asked to execute the resolution presented by <br />staff. This resolution authorizes the application to the Minnesota Department of Trade and <br />Economic Conta~nination Cleanup Grant Program. The grant application, as requested, will be <br />used to finance ~ to $50,000 to be used to finance more environmental study to determine the <br />m~t~gat~on elemegts that are necessary to clean up the s~te from lead contamination. <br /> <br />Councilmember JStrommen stated that she thought it was great that the property owner was <br />researching gran~ opportunities. She inquired as to what it meant for the City to act as the legal <br />sponsor. <br /> <br />Assistant DirectC~r of Public Works Olson explained that the application was supplied by the <br />Department of T~'ade and Economic Development and any cost associated with the application <br />and study would [be the developer's responsibility. He stated that he thought the City would want <br />to be the legal ~ponsor to show support for the study and to make sure the information is <br />accurate. <br /> <br />City Attorney Ooodrich recommended that an additional 'Therefore' be added stating by <br />adopting the resoiution the City does not accept any legal liability for any lead contamination that <br />may exist on the ~)roperty. <br /> <br />Councilmember ~Elvig inquired if by adding the language to the resolution they are eliminating <br />any legal ramifications for the City if lead is found on the property. <br /> <br />City Attorney Go~bdrich replied in the affirmative. <br /> <br />Councilmember ]~lvig inquired if the City was going to be overseeing the process. <br /> <br />Assistant Directo~ of Public Works Olson replied that staff would want to retain a consultant to <br />review the inforr~ation provided from the study. <br /> <br /> . <br />Councilmember ~lvig inquired if the landowner would be subjected to paying those fees for the <br />cost of the revieW. <br /> <br />Assistant Directdi' of Public Works Olson replied that he believed that those are costs that will be <br />covered by the f~asibility study that will be occurring for the same area, but that was something <br /> · <br />staff could reqtep~te. <br /> <br /> ? <br />Councilmember Kurak stated that she thought the grant was a great idea, but she did not thirflc <br />that the City should have to pay any fees. <br /> <br />Motion by Com~cilmember Kurak, seconded by Councilmember Pearson, to adopt Resolution <br />#03-10~279 autt~rizing application to the Minnesota Department of Trade and Economic <br />Development co~tarnination cleanup grant program for various projects as amended by the City <br />Attorney and tha~ any expenses incurred by the City as a result of the study will be paid for by the <br />landowner or de')eloper. <br /> <br /> City Council/October 14, 2003 <br /> Page 17 of 30 <br /> <br />69¸ <br /> <br /> <br />
