Pursuant to
staff's request, Mr. Sauter applied for a conditional use permit to stockpile demolition concrete
on his property for purposes of crushing it into .a~.ag~egate to be used on other job sites. The
Plarming Commission met on October 2, 2003, and recommended denial of the conditional use
permit. Since the Planning Commission meeting, staff met with Mr. Sauter and he indicated that
he no longer wanted to pursue the matter. Mr. Sauter requested 60 days to crush the concrete and
remove it from the site.

Councilmember Zimmennan inquired if the materials came from a project in Ramsey.

Assistant Community Development Director Trudgeon replied that he was not sure.

Councilmember Zimmerman inquired if Mr. Sauter felt that 60 days was enough time to remove
all of the material.

Assistant Community Development Director Trudgeon replied that Mr. Sauter felt that 60 days
would be adequate.

Councilmember Kurak inquired as to what assurances does the City have that the materials will
be removed within 60 days.

Assistant Community Development Director Trudgeon replied that the City would have no
recourse other than bringing the issue back to the Council.

Motion by Councilmember Cook, seconded by Councilmember Elvig, to allow Sauter and Sons,
Inc. 60 days to demolish and remove concrete from their site located at 6651 - 141~t Avenue NW,
Ramsey.

Further discussion: Councilmember Strommen inquired if there were still environmental
concerns. Assistant Community Development Director Trudgeon replied that staff did not have
any fm-ther information on environmental issues. Community Development Director Frolik
noted that she had talked to pollution control and they indicated that they would have to assume
that Mr. Sauter received the appropriate permits prior to demolition. Councilmember Elvig
recommended that the City veri~ that Mr. Sauter did have the appropriate demolition permits.

Motion was amended to direct staff to verify that the appropriate demolition pen-nits were
received.

-70-

City Council/October 14, 2003
