the event the Ra~sey Town Center project trunk lines are not projected to be operable on a date <br />acceptable to th~ City Engineer, the developer shall commence work to substitute the alternate <br />temporary holdir{? facility with the required lift Station or gravity system. In order to ensure that <br />this work gets co~npleted, the City is requiring an escrow of $155,000 to deposited with the City. <br /> <br />Councihnember Elvig stated that he recalled discussing that the units along C.R. #116 would be <br />staggered so that~the units did not look like a straight wall, but he did not see that reflected on the <br />final plat. ~ <br /> <br />Phil Dommer, Bright Keys, explained that the boxes on the final plat are the boundary lines for <br />the common interest community lot. The building themselves are staggered and there is a <br />generou·s amoun~of space between the two units. <br /> <br />Assistant Comm~nity Development Director Trudgeon stated that along Ramsey Boulevard the <br />final plat indicates that right of access restricting any additional accesses has been dedicated to <br />the County, but tfiat was not the case along ~,..R. #116. <br /> <br />Mr. Dommer reOlied that he had no problem with making that change on the final plat. He <br />inquired if the w{ll house access should be included. <br /> <br />Assistant Directo)7 of Public Works Olson replied that the City is able to give up that access as <br />well. <br /> <br />Motion by Coun{ilmember Kurak, seconded by Councilmember Elvig, to adopt Resolution #03- <br />10-282 to approCpe the final plat of Town Center Gardens contingent upon compliance with City <br />staff review letter dated October 10, 2003 and the Developer entering i~to a Development <br />Agreement with fl~e City. <br /> <br />Motion carried. ~oting Yes: Mayor Gamec, and Councilmembers Kurak, Elvig, Cook, Pearson, <br />Strommen, and ~mmerman. Voting No: None. <br /> ,. <br />Case #13:' R~quest for a Conditional Use Permit for a School Located in the Town <br /> C ,~nter 3A Subdistrict <br /> <br />Assistant CommUnity Development Director Trudgeon stated that Academic Investments h~c. <br />has submitted a site plan to construct a two-story, 71,350 square-foot Charter School on Lot 1, <br />Block 1, of the proposed Town Center subd!,vision. The Planning Commission reviewed the site <br />plan for the Sch~bol on September 15, 2002, and recommended approval. On September 22, <br /> ~ C'[;ouncil approved the site plan subject to the applicant receiving a Conditional <br /> 00~, the City <br />Use Permit in ac{ordance with the Ramsey Town Center Zoning District Guidelines. The TC- <br />3a sub district requires that schools located in the Town Center must receive a conditional use <br />permit (CLIP). .h~ the Planning Commission site plan review, it was brought forward by Staff <br />that there were al few areas where the site plan did not meet all of the proposed Town Center <br />Draft Deve]opm~t Guidelines.
