Councilmember Elvig introduced the following resolution and moved for its adoption: RESOLUTION #09-04-078A A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO LIGHTHOUSE LEARNING CENTER, LLC ALLOWING THE OPERATION OF A TH DAYCARE FACILITY ON THE PROPERTY LOCATED AT 5900 167 AVENUE NW, BASED ON FINDINGS OF FACT #0842; AND DECLARING THE TERMS OF SAME. WHEREAS, Lighthouse Learning Center, LLC, hereinafter referred to as "Permittee", properly applied to the City of Ramsey (the "City") for a Conditional Use Permit (the “Permit”) to st operate a daycare facility on the property generally known as 5900 167 Ave NW and legally described as follows: The north 426.29 feet, as measured along west line, of that part of Southwest Quarter of Southeast Quarter of Section 11, Township 32, Range 25 lying westerly of center line of Trunk Highway No. 47, except road, subject to easement of record, Anoka County, Minnesota (the "Subject Property") WHEREAS, the Planning Commission met on April 2, 2009, conducted a public hearing pursuant to Section 9.03.05 of the Ramsey City Code and recommended that City Council approve the request for a Conditional Use Permit. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: This Permit is issued pursuant to Section 9.03.05 of the Ramsey City Code. The conditions of this Permit are as follows: 1)That the Permittee shall be allowed to operate a daycare facility on the Subject Property, as shown on the site plan dated March 2, 2009 prepared by Phillip D. Johnson, herein attached as Exhibit A, effective upon the date of City Council approval. 2)That the Permittee shall adhere to all applicable State Building and State Fire Codes regarding the operation of a daycare facility. 3)That the Permittee shall adhere to all State Daycare Licensing Requirements. 4)That the Permittee shall install or have installed both a fire detection and alarm system in the unit and a fence for the outdoor play area prior to opening for business. 5)That the Permittee shall be responsible for obtaining all necessary permits prior to fence installation or building modifications. 6)That this Permit shall not be considered modified, altered, changed or amended in any respect unless in writing and signed by the City and the Permittee. 7)That this Permit shall be perpetual in duration as long as the terms are herein complied with.
