of the working face be left unattended with a slope greater than 2 feet horizontal to <br />1 foot vertical. When mining operations are anticipated to be discontinued for an <br />interval greater than one working day, the slopes shall be flattened to a grade no <br />steeper than 4 feet horizontal to 1 foot vertical. <br /> <br /> <br />13.Prior to commencing any grading operations, a cash escrow or letter of credit <br />approved as to form by the City in the amount of Ten Thousand Dollars and no <br />cents ($10,000.00) shall be deposited with the City. This financial guarantee may <br />be used by the City to pay for the cost and expense of repairing any public right of <br />ways or regrading and stabilizing eroded areas due to the grading operation, pay <br />for any cost associated in administering the requirements of this Chapter of the <br />City Code, and to pay for any restoration of the work site not properly restored <br />upon completion. The Permit Holder agrees to permit access to the property by <br />the City to facilitate restoration, if necessary. <br /> <br /> <br />14.The Permit Holder shall implement sediment and erosion control practices. No <br />grading activity shall occur within twenty-five (25) feet of a property line unless <br />silt fence is placed along the property line to prevent sediment from washing onto <br />the adjoining property. Any erosion which causes gullies of greater than one (1) <br />foot within twenty-five (25) feet of a property line shall be regraded within forty- <br />eight (48) hours of the precipitation event that caused the erosion. <br /> <br /> <br />15.There shall be no stockpiling of graded materials, other than the topsoil on a <br />temporary basis, allowed within the boundaries of the Subject Property. <br /> <br /> <br />16.The permit holder shall file with the City a liability insurance policy or certificate of <br />such insurance acceptable to the City and issued by an insurance company <br />authorized to do business in the State of Minnesota. <br /> <br /> <br />17.The policy shall insure the permit holder for the sum of at least $300,000 for injury <br />to one person and $500,000 for one accident, and at least $1,100,000 property <br />damage. <br /> <br /> <br />18.Said policy shall be for the full period of the permit and shall provide for the giving <br />of 30 days prior notice to the City by registered mail of termination, cancellation or <br />amendment of the policy. <br /> <br /> <br />19.In the event said policy is terminated for any reason, the permit shall be <br />automatically suspended upon the day the policy terminates unless a new policy <br />complying with this item is obtained and filed with the City prior to the termination <br />of the policy in force. <br /> <br /> <br />20.The maximum noise level at the perimeter of the work site shall be within the limits <br />set by the Minnesota Pollution Control Agency and the Environmental Protection <br />Agency of the United States. <br /> <br />Resolution #05-07-235 <br />Page 3 of 5 <br /> <br /> <br />
