21.All costs incurred by the City in executing and administering this permit shall be the responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to reimburse the City for expenses incurred in the administration of this permit. At the time the mining operation and site restoration are completed to the satisfaction of the City, the balance of the escrow shall be returned to the Permit Holder. 22.All grading operations shall be conducted between 7:00 a.m. and 8 p.m. on weekdays only unless otherwise specifically approved by the City Administrator and/or his designee. 23.The amount of dust or other particulate matter caused by the mining operation shall not exceed the standards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gust exceeds 30 miles per hour. 24.All operations shall comply with all applicable Minnesota Pollution Control Agency regulations and Federal and Environmental Protection Agency regulations for the protection of water quality. The applicant is responsible for obtaining all necessary environmental permits The motion for adoption of the foregoing resolution was duly seconded by Councilmember Cook, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Pearson Councilmember Cook Councilmember Elvig Councilmember Jeffrey Councilmember Olson Councilmember Strommen and the following voted against the same: None and the following abstained: None and the following were absent: None whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this th the 26 day of July, 2005.
