<br />4)That the display or storage of motor or recreational vehicles on the Subject Property shall be <br />restricted to those areas that maintain the required improvements. Violation of this provision <br />or any other provision will be cause for revocation of the motor vehicle sales license. <br /> <br /> <br />5)That the Permittee shall be responsible for obtaining a permit from the Lower Rum River <br />Watershed Management Organization and any additional permits required by other applicable <br />regulatory agencies. <br /> <br /> <br />6)That the Permittee shall provide a financial guarantee to the City, guaranteeing the <br />construction and timely completion of the required site improvements described herein. The <br />financial guarantee shall be in the amount of Seventeen Thousand Eight Hundred and no cents <br />($17,800.00), which amount is 125% of the City Engineer's estimated cost of the required site <br />improvements. The form and issuer of the financial guarantee shall be subject to the approval <br />of the City. The financial guarantee shall be deposited with the City prior to the construction <br />and installation of the second product silo on the Subject Property. Upon total completion of <br />the site improvements and acceptance by City, the Permittee may request a total reduction in <br />the amount of the financial guarantee. <br /> <br /> <br />7)That this Permit shall not be considered modified, altered, changed or amended in any respect <br />unless in writing and signed by the City and the Permittee. <br /> <br /> <br />8)That the City shall have the right to inspect the premises for compliance and safety purposes <br />annually or at any time, upon reasonable request. <br /> <br /> <br />9)That the terms of this Permit shall be binding upon its successors and assigns. <br /> <br /> <br />10)In the event the Permittee, or its successors, or assigns, violates the terms of this Permit, said <br />violation shall be grounds for suspension or revocation pursuant to Section 9.03.04 Subd. 9 of <br />the City Code. <br /> <br /> <br />11)In the event any part of this IUP is declared void or unenforceable by a court or competent <br />jurisdiction, the other provisions shall not be affected but shall remain in full force and effect. <br /> <br /> <br />12)That all costs incurred by the City in administering and enforcing this Permit shall be the <br />responsibility of the Permittee. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Elvig, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Gamec <br /> Councilmember Cook <br /> Councilmember Elvig <br /> Councilmember Pearson <br /> Councilmember Strommen <br /> Councilmember Zimmerman <br /> <br />and the following voted against the same: <br /> <br /> None <br />RESOLUTION #04-02-057 <br />Page 3 of 5 <br /> <br />
