<br />Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-11-345 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0708 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE SIXTY (60) FOOT BUFFERYARD REQUIREMENT IN <br />THE E-1 EMPLOYMENT DISTRICT. <br /> <br /> WHEREAS, <br /> TSM Development, Inc., hereinafter referred to as “Applicant,” has properly <br />applied for a variance from Section 9.20.24 regarding minimum bufferyard requirements in the E- <br />1 Employment District on the property generally located on Ramsey Blvd and Bunker Lake Blvd <br />and legally described as follows: <br /> <br />Outlot A, Regency Pond, Anoka County, Minnesota. <br /> <br />(the “Subject Property”) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br /> <br />1.That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on November 4, 2004, and that said public hearing was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br /> <br />2.That the Subject Property is zoned E-1 Employment and is approximately 4.8 acres in size. <br /> <br /> <br />3.That properties to the north and east are zoned R-1 Residential. <br /> <br /> <br />4.That the property to the south and west is street right of way. <br /> <br /> <br />5.That mini storage is a permitted use in the E-1 Employment District. <br /> <br /> <br />6.That section 9.20.24 (E-1 Employment District) requires a sixty (60) foot setback between <br />parcels zoned E-1 Employment and those zoned R-1 Residential. <br /> <br /> <br />7.That the Applicant is requesting a variance from the 60-foot bufferyard requirement along the <br />northern property line of Outlot A, Regency Pond, in order to construct bituminous surface <br />and buildings within 30 feet of said property line. <br /> <br /> <br />8.That the Applicant will construct an eight-foot high privacy fence around the perimeter of the <br />development to help mitigate the lesser bufferyard. <br /> <br /> <br />
