<br />9.That the Applicant has stated that given the unusual shape of the subject property it is <br />practically difficult to develop the site to its potential and accommodate a 60-foot bufferyard <br />on the northern property line of Outlot A, Regency Pond. <br /> <br /> <br />10.That the Applicant has stated the variance requested is the minimum variance needed to <br />alleviate the hardship. <br /> <br /> <br />11.That if granted, the variance will not permit a use that is prohibited in the E-1 Employment <br />District. <br /> <br /> <br />12.That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br /> <br /> <br />13.That if granted, the variance will not endanger the public safety. <br /> <br /> <br />14.That if granted, the variance will not unreasonably diminish property values in the <br />neighborhood. <br /> <br /> <br />15.That if granted, the variance will not violate the intent of the Comprehensive Plan. <br /> <br /> <br />16.That, if granted, the variance will not grant the Applicant any special privileges that are denied <br />to other owners of land in the same district. <br /> <br /> <br />17.That undue hardship will not result if the variance request is denied due to the existence of <br />special conditions and circumstances which are peculiar to the land and which are not <br />applicable to other lands in the same district. <br /> <br /> <br />18.That the special conditions do not result from the actions of the Applicant. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Brauer, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Chairperson Nixt <br /> Board Member Brauer <br /> Board Member Shepherd <br /> Board Member Watson <br /> <br />and the following voted against: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />RESOLUTION #04-11-345 <br />Page 2 of 3 <br /> <br />
