Councilmember Kurak introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-03-068 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #068 RELATING TO A REQUEST <br />FOR AN INTERIM USE PERMIT TO ALLOW FOR OUTSIDE STORAGE OF <br />COMMERCIAL VEHICLES AND EQUIPMENT AND EXCESS PRODUCT ON A <br />RESIDENTIALLY ZONED PARCEL. <br /> <br /> WHEREAS, Gerald Bauer, hereinafter referred to as "Applicant", has properly applied to <br />the City of Ramsey (the "City") for an interim use permit for outdoor storage of commercial <br />vehicles and equipment and excess paving materials on the property generally known as 16130 <br />Variolite Street and legally described as follows: <br /> <br />The Southwest Quarter of the Northeast Quarter and the Northwest Quarter of the <br />Southeast Quarter in Section 16, Township 32, Range 25, Anoka County, <br />Minnesota. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That on January 22, 2003, the Applicant submitted a request for a two-year Interim Use <br />Permit (IUP) to allow for outside storage of commercial vehicles and equipment and <br />stockpiling excess paving product (clean sand and gravel) on the Subject Property. <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on February 6, 2003, and that the <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />3. That the Subject Property is zoned R~I Residential and the surrounding parcels are zoned <br /> R-1 Residential. <br /> <br />4. That the Subject Property is approximately 40 acres in size, but part of a 120 acre land <br /> area held in fee title by the Applicant. <br /> <br />That the Applicant owns and operates Ramsey Shooting Center LLC located on the <br />Subject Property and Ramsey Shooting Center LLC is an existing legal non-conforming <br />business. <br /> <br />That the shooting center has existed on the Subject Property for more than 20 years and is <br />considered an intense commercial use because of the noise and traffic levels reaching <br />approximately 100 vehicles a day during the peak sporting season. <br /> <br />That the Applicant has stated that the low intensity of the proposed interim use is <br />substantiated by the fact that Able Paving has been basing their operation from the <br />Subject Property virtually unnoticed for two years. <br /> <br /> <br />
