That Able Paving has stated that the proposed use would include some routine <br />maintenance of vehicles and equipment that would be conducted within an existing <br />accessory structure on the Subject Property. <br /> <br />9. That Able Paving has stated that the proposed use would include some stockpiling of <br /> clean fill and recycled Class 5 on the Subject Property. <br /> <br />10. That in the recent past, the Applicant has respectfully reduced the amount of shooting <br /> activity conducted on the Subject Property in an attempt to respond to neighborhood <br /> complaints regarding noise levels during the peak shooting season. <br /> <br />11. That the Applicant has stated that the proposed interim use would provide the opportunity <br /> to replace revenues lost as a result of the decreased shooting activity negotiated for the <br /> benefit of the surrounding neighborhood. <br /> <br />12. That in response to the public hearing, some of the surrounding residents have stated that <br /> the proposed use will adversely impact traffic in the area due to the addition of six slow <br /> moving commercial vehicles utilizing Variolite Street during peak traffic periods. <br /> <br />13. That Able Paving has stated that the interim use proposed has minimal impact on traffic <br /> as the operation consists of 6 vehicles that would transport personnel and equipment from <br /> the Subject Property at approximately 6:00 a.m. and return to the Subject Property at <br /> approximately 6:00 p.m., Monday through Saturday. <br /> <br />14. That Variolite Street N.W. is a Municipal State Aid road and the City Engineering <br /> Department has determined that it can sustain the additional traffic generated by the <br /> proposed use. <br /> <br />15. That the proposed interim use will not be unduly dangerous or otherwise detrimental to <br /> persons residing or working in the vicinity of the use or to the public welfare. <br /> <br />16. That the proposed interim use will not substantially adversely impair the use, enjoyment, <br /> or market value of surrounding property. <br /> <br />17. That the proposed interim use will not be disturbing to existing or future neighboring uses <br /> for the interim period of time because of the minimal size of the operation in comparison <br /> to the size of the property, and the proximity to a Municipal State Aid road. <br /> <br />18. That the proposed interim use will be se~wed adequately by public facilities and services <br /> such as highways and streets. <br /> <br />19. That the proposed interim use will not create excessive additional requirements at public <br /> cost for public facilities and services, and it will not be detrimental to the economic <br /> welfare of the community. <br /> <br />20. That the proposed interim use will not involve activities and uses that will be detrimental <br /> to any persons, property, or the general welfare by reason of excessive production of <br /> traffic, noise, smoke, fumes, glare, or odors. <br /> <br />RESOLUTION #03-03-068 <br /> Page 2 of 3 <br /> <br /> <br />
