Councilmember Cook introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 03-05-109 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0647 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM DARYL AND CAROL <br />RICHMOND TO EXCEED THE SIZE RESTRICTION FOR DETACHED ACCESSORY <br />BUILDINGS ON PROPERTIES LOCATED OUTSIDE THE METROPOLITAN URBAN <br />SERVICE AREA. <br /> <br /> WHEREAS, Daryl and Carol Richmond, hereinafter referred to as the "Applicants," <br />have properly applied for a Conditional Use Permit to exceed the size restriction for detached <br />accessory buildings on properties located outside the Metropolitan Urban Service Area (MUSA) <br />on the property generally known as 17623 Marmoset St. NW and legally described as follows: <br /> <br />Lot 3, Block 4, Countryside Estates, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on May 1, 2003, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated by <br />reference. <br /> <br />2. That the Subject Property is zoned R-1 Rural Developing, and is located outside the <br /> Metropolitan Urban Service Area (MUSA). <br /> <br />3. That the Subject Property is approximately 1.94 acres (84,506.4 square feet) in size. <br /> <br />4. That the Subject Property is bordered to the north and east by a 50 foot outlot. <br /> <br />5. That the surrounding properties are zoned R-1 Rural Developing. <br /> <br />6. That City Code restricts the Subject Property to a total of 1,664 square feet of accessory <br /> building space. <br /> <br />o <br /> <br />That the Applicants have an existing primary garage totaling 624 square feet; the new <br />accessory building is proposed to be 1,440 square feet in size; resulting in a total of 2,064 <br />square feet of accessory building space on the Subject Property. The net result is a 400 <br />square foot overage for the subject property. <br /> <br />8. That the proposed accessory structure will not exceed the height restrictions (16 feet as <br /> measured to the mean gable height) for the R-1 Rural Developing zoning district. <br /> <br /> <br />
