<br />1.That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on September 4, 2003, and that said public hearing was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br /> <br />2.That the Subject Property is zoned R-1 Rural Developing, is located outside the 2020 <br />Metropolitan Urban Service Area, and is approximately 1.27 acres in size. <br /> <br /> <br />3.That the Subject Property is surrounded by properties zoned R-1 Rural Developing. <br /> <br /> <br />4.That Section 9.20.11 of the Ramsey City Code states that the side yard setback for an <br />accessory structure is ten (10) feet. <br /> <br /> <br />5.That there is an existing attached garage totaling 988 square feet and an existing detached <br />garage totaling 252 square feet on the Subject Property, resulting in a net total of 1,240 <br />square feet of accessory structure space. <br /> <br /> <br />6.That the proposed structure will be 240 square feet in size (resulting in a total of 1,480 square <br />feet of accessory structure space on the property). <br /> <br /> <br />7.That the allotted square footage for accessory structures for the Subject Property is 1,664; the <br />overall square footage for accessory structures will not exceed the maximum square footage <br />stated in City Code. <br /> <br /> <br />8.That the Applicant is proposing to construct an accessory building that will be six and a half <br />feet (6.5) from the property line. <br /> <br /> <br />9.That the Applicant wants to construct the proposed accessory structure in such a location to <br />eliminate the need to remove mature oak trees on the Subject Property. <br /> <br /> <br />10.That to meet the minimum side yard setback of ten (10) feet for an accessory structure would <br />require the removal of a minimum of two mature oak trees. <br /> <br /> <br />11.That this is the only location on the property that the structure could be placed so that no <br />trees would need to be removed. <br /> <br /> <br />12.That the western portion of the property contains the septic system and also the alternate site <br />for the septic system in case of failure. <br /> <br /> <br />13.That the Applicant has stated that proposed accessory structure would be utilized for storage <br />of personal property. <br /> <br /> <br />14.That in accordance with City Code, the proposed building will be constructed of materials <br />similar to that of the home. <br /> <br /> <br />15.That the variance requested is not the minimum variance which would alleviate the hardship in <br />regard to the height of the structure. <br /> <br />RESOLUTION #03-09-228 <br />Page 2 of 4 <br /> <br />
