Commissioner Deemer noted that the proposed conditional use permit should specify that the operations are limited to within the County right-of-way. Motion by Commissioner Hendriksen to table action on the request for a conditional use permit. Further Discussion: Mr. Otto noted that the contractor, Busse Construction, is under a 60 day time limit to complete the improvements to County Road #83. Motion failed for lack of a second. Mr. Otto explained that the contractor is obligated to complete the improvements within 60 days and was under the impression that the County had coordinated obtaining all of the necessary permits. As a result of the project modification to obtain fill material from the County right-of-way and replace it with the excavated muck material from the Trott Brook floodway, the proposed conditional use permit will only apply to the City's Flood Plain Ordinance. The regulatory agencies with respect to working in the flood plain are the DNR and Army Corps of Engineers; those agencies have reviewed the project and issued permits. The Commission proceeded to review and amend the proposed findings of fact as follows: Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to amend Item #20 of the proposed findings of fact to indicate that the subject property is County Road #83. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, Deemer, Terry and Thorud. Voting No: None. Absent: Commissioner Bawden. Motion by Commissioner LaDue and seconded by Commissioner Hendriksen to delete Item #22 of the proposed findings of fact. Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, Deemer, Terry and Thorud. Voting No: None. Absent: Commissioner Bawden. Motion by Commissioner Deemer and seconded by Commissioner Terry to delete Item #23 of the proposed findings of fact. Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, Deemer, Terry and Thorud. Voting No: None. Absent: Commissioner Bawden. Motion by Commissioner Terry and seconded by Commissioner Hendriksen to delete the term 'stockpiling' from Item #24 of the proposed findings of fact. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, Deemer, Terry and Thorud. Voting No: None. Absent: Commissioner Bawden. Motion by Commissioner Terry and seconded by Commissioner Hendriksen to amend Item #14 of the proposed findings of fact to clarify that improvements to County Road #83 refers to work in the wetland and changing the cross section of the channel of public waters.
