The Commission proceeded to review the City Engineer's report dated May 9, 1990. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to accept <br />the preliminary plat and recommend that City Council grant final plat approval to Park 67 <br />Industrial Park Addition as a minor subdivision contingent upon: a) Compliance with items <br />contained in the City Engineer's report dated May 9, 1990 and the recommendation of the <br />Park and Recreation Commission dated May 8, 1990; b) Providing a covenants on Lot 1, <br />Block 1, requiring soil borings prior to any building construction; c) Providing a <br />covenants on the entire plat prohibiting any further building construction prior to <br />connection to municipal sewer and water services; d) Providing a complete topography on <br />the entire plat. <br /> <br />Further Discussion: Commissioner Hendriksen stated that he would like to see some <br />assurance that the lots in the plat will ultimately be served by Tungsten Street and will <br />participate in the cost of that improvement project. Mr. Banwart explained to Stan <br />Lebakken, a parmer in Park Acquisition, that technically Lots 2 and 3 are landlocked from a <br />City Code standpoint because they do not have 200 feet of frontage on a public street; <br />Planning and Zoning is willing to facilitate the plat proposal contingent upon the owners of <br />Park 67 participating in the Tungsten Street improvement project when it occurs. <br /> <br />Amendment by Commissioner Hendriksen and seconded by Commissioner Deemer to <br />include language in the Development Agreement for Park 67 Industrial Park indicating that <br />Lots 1, 2 and 3 will participate on an equal basis in the cost of improvements to Tungsten <br />Street when it is constructed. <br /> <br />Further Discussion: Jeff Caine noted that the plat is a minor subdivision and could not <br />understand the Commission's reason for requiring a topography. Commissioner Deemer <br />noted that the terrain of the property has changed considerably. <br /> <br />Amendment carded. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, <br />LaDue, Deemer, Thorud and Terry. Voting No: None. Absent: Commissioner Bawden. <br /> <br />Further Discussion: Commissioner Hendriksen noted that in the previous discussions, <br />Commissioner Deemer indicated that things have been buried on one of the lots. <br />Commissioner Deemer explained that the particular lot was an approved dump site that has <br />just been capped. Mr. Banwart noted that the past use of the lot will be noted in the <br />development agreement also. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Deemer, Thorud and Terry. Voting No: None. Absent: Commissioner Bawden. <br /> <br />Case #5: Request For A Conditional Use Permit For Grading, Mining, <br /> Filling And Stockpiling; Case Of Gene Moskop, Busse <br /> Construction, Inc.: <br /> <br />The Commission proceeded to review the City Engineer's report dated May 9, 1990. Mr. <br />Otto noted that the Engineer's report focuses on the grading and mining aspect of the <br />project and is no longer relevant as the project scope is now modified to excavating and <br />filling the Trott Brook floodway totally within the County right-of-way with no utilization <br />of private property. <br /> <br />Planning And Zoning Commission/May 15, 1990 <br /> Page 5 of 9 <br /> <br /> <br />
