The Commission proceeded to review the City Engineer's report dated September 26, 1990. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to approve the sketch <br />plan for the proposed Faye Addition contingent upon compliance with items contained in the City <br />Engineer's report dated September 26, 1990, especially with respect to Item #7 regarding access to <br />the adjacent Kelly property, redesigning the plan to eliminate the westerly cul-de-sac that exceeds <br />the maximum 600 foot length and to require that the developer submit the preliminary plat to the <br />Planning and Zoning Commission for a review prior to scheduling a public hearing. <br /> <br />Further discussion. Commissioner Deemer stated that he is requesting a preview of the <br />preliminary plat prior to the preliminary plat public hearing because of anticipated changes in the <br />City's zoning ordinance and how they may affect the proposed Faye Addition. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Bawden, Deemer, LaDue, <br />Terry and Thorud. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />Mr. Chapman requested being provided with the City's proposed amendment to the zoning <br />chapter. <br /> <br />The Commission recessed at 8:55 p.m. <br /> <br />Chairman Zimmerman called the meeting back to order at 9:13 p.m. <br /> <br />Case #4; Request for a Conditional Use Permit to Expand an Aluminum <br /> Reggvery an0 Processing Business: Case of Danny's Aluminum <br /> Processint,. Inc. <br /> <br />Mr. Otto stated that the purpose of Mr. Karst's application for a conditional use permit is to expand <br />an aluminum processing operation that currently exists under a conditional use permit approved on <br />April 25, 1989. Mr. Otto stated that Mr. Karst is proposing to double the capacity of his facility by <br />bringing another furnace on line. Mr. Otto also noted that the applicant has received notice from <br />MPCA that his facility is exempt from requiring an air emission permit from MPCA based on the <br />conclusion that the potential to emit each of the criteria pollutants is less than 25 tons per year. <br />Based on that, Mr. Karst is requesting that the City modify the conditional use permit terms to <br />eliminate annual testing for those pollutants unlikely to be found in more than trace amounts. <br /> <br />Mr. Otto stated that another concern of City staff is that the operation has expanded off site. The <br />original conditional use permit was issued for 14050 Basalt Street N.W. Since that time, Mr. <br />Karst has acquired two other lots in the vicinity on which he is storing buses, which are later <br />dismantled and used as feed stock for his aluminum processing operation. Mr. Otto noted that in <br />1989, there were also six police incident reports related to excessive smoke emissions at Mr. <br />Karst's facility. As a result of those reports, City staff met with Mr. Karst in December of 1989 <br />and it was indicated to Mr. Karst that he would have to modify his operations or insure that his <br />employees understand how the equipment was to be operated. Since that meeting, the incident <br />repons have reduced in number to two in 1990, both of which happened within a couple of days of <br />each other in April. <br /> <br />Mr. Otto also noted that the electrical wiring in the facility is not up to code and Mr. Karst is <br />attempting to remedy that situation. <br /> <br />Commission Deemer stated that, in his opinion, the City should not be considering issuing a <br />conditional use pemfit to expand a facility under the conditions that currently exist there. <br /> <br />Planning and Zoning Commission/October 2, 1990 <br /> Page 5 of 8 <br /> <br /> <br />
