Councilmember Cook introduced the following resolution and moved for its adoption:

RESOLUTION #05-07-229

RESOLUTION ADOPTING FINDINGS OF FACT #0729 TO RELATING TO A
REQUEST FOR PRELIMINARY PLAT APPROVAL OF A SUBDIVISION PROPOSED
TO BE NAMED RUM RIVER ESTATES ADDITION.

WHEREAS,
National Growth, hereinafter referred to as “Applicant,” has properly
applied for preliminary plat approval of Rum River Estates Addition on the following described

property located in the City of Ramsey:

The north 330.00 feet of the Northwest Quarter of the Northeast Quarter of Section 23,
Township 32, Range 25, together with an easement for road purposes over the west
33.00 feet of that part of the Northeast Quarter of said Section 23 which lies north of
County State Aid Highway No. 5, according to the United States Government survey
thereof, Anoka County, Minnesota.

(the “Subject Property”)

NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF
RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating
to the request are determined to be as follows:

1.That Section 9.20.11 (R-1 Residential District) of the City Code permits single family
residential units at a density of 3 units per acre; or 4 units per acre as a Planned Unit
Development that includes townhomes.

2.That on December 13, 2004, the City of Ramsey received an application and sketch plan
for the proposed plat of Rum River Estates consisting of approximately 10 acres to be
developed with 26 detached townhome units, for a density of 3.2 units per acre, and
access provided by a 1,105 foot cul-de-sac that exceeds the 600 foot maximum length
established by City Code.

3.That on January 6, 2005, the Planning Commission reviewed the sketch plan and
determined that the density should be reduced and although density transitioning is not
required in this case, there should be some provided on the common property line with the
residential units to the north.

4.That on January 25, 2005, the City Council reviewed a revised sketch plan that reduced
the number of units from 26 to 24 and the following concerns were raised: density,
benefits to the City for the PUD, the length of the cul-de-sac, the lack of density
transitioning or buffering on the north property line, and the uncertainty of the Potassium
Street right-of-way.

5.That on February 11, 2005, the Applicant’s submitted a preliminary plat for Rum River
Estates to the City.
