Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend the proposed <br />Conditional Use Permit to eliminate Item #1 which sets a term on the permit of five (5) years and <br />amend the language of the permit to indicate that the permit will remain in effect so long as the <br />conditions imposed are complied with. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. <br /> <br />Motion by Commissioner Deemer and seconded by Chairman Zimmerman to amend the proposed <br />Conditional Use Permit to reflect a legal description of the subject property that will be inclusive of <br />the additional property the applicant is proposing to purchase. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud, Deemer, <br />Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Bawden. <br /> <br />It was noted that the City Attorney was provided with a copy of the proposed conditional use <br />permit and staff has not received any comment from him as of yet. <br /> <br />The Commission recessed at 9:35 p.m. <br /> <br />Chairman Zimmerman called the meeting back to order at 9:55 p.m. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Thorud to table any further <br />action regarding Mr. Rychner's request for a conditional use permit in order to solicit an opinion <br />from the City Attorney regarding whether or not the proposed recycling operation of Mr. <br />Rychner's proposal is subject to Ordinance ~90-5 and an opinion from the City Attorney regarding <br />the proposed terms of the conditional use permit. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Thorud and Hendriksen. <br />Voting No: Deemer and LaDue. Absent: Commissioners Terry and Bawden. <br /> <br />Commissioner Hendriksen stated that he also sees no purpose in reviewing Case #2, Mr. <br />Rychner's proposed site plan, until the conditions of the conditional use permit are known. <br /> <br />Mr. Glen Rychner noted that the site plan deals almost exclusively with the aluminum smelting <br />operation, which is not subject to Ordinance #90-5. <br /> <br />Mr. Otto noted that some additional points of information have been brought out in tonight's <br />discussion that he was not aware of when he prepared the proposed conditional use permit based <br />on Mr. Rychner's application. Those points of information include whether or not there will be <br />some processing of the recyclable items on site and if so, those operations should also be <br />addressed in the terms of the conditional use permit. <br /> <br />RECESS <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recess this <br />special Planning and Zoning Commission meeting to Thursday, December 6, 1990, immediately <br />following the special Board of Adjustment meeting, contingent upon the additional information <br />requested from the City Attorney being available at that time. <br /> <br />Planning and Zoning Commission/November 20, 1990 <br /> Page 8 of 9 <br /> <br /> <br />
