Motion by Commissioner Bawden and seconded by Commissioner Deemer to delete item #3 due to <br />the fact that, again, the height of the tower is the main concern. <br /> <br />Motion carried. Voting Yes: Acting Chairman Hendriksen, Commissioners Bawden, Deemer, <br />LaDue, Terry and Thomd. Voting No: None. Absent: Chairman Zimmerman. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Deemer that the words "side or" <br />should be stricken from item #4 (now item #3) and shall now read "The location of the tower <br />structure is restricted to rear yard and shall maintain a minimum setback of 30 feet from all property <br />lines. <br /> <br />Motion carried. Voting Yes: Acting Chairman Hendriksen, Commissioners Terry, Deemer, <br />Bawden, LaDue and Thorud. Voting No: None. Absent: Chairman Zimmerman. <br /> <br />The remainder of the items shall read as they are presented, therefore, the only changes will be the <br />numbering sequence. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry that a new condition be <br />added. It shall read "The base of the tower shall be restricted from access by a 4', non-climable <br />barrier. <br /> <br />Motion carried. Voting Yes: Acting Chairman Hendriksen, Commissioners Deemer, Terry, <br />Bawden, LaDue and Thomd. Voting No: None. Absent: Chairman Zimmerman. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Deemer to add another new <br />condition to read "Applicant shall plant up to 20 trees, 20' to 30' tall along Traprock Street N.W. <br />as proposed by Mr. Monson in Exhibit 1, by May 1, 1992. <br /> <br />Motion carried. Voting Yes: Acting Chairman Hendriksen, Commissioners Terry, Deemer, <br />LaDue, Thorud and Bawden. Voting No: None. Absent: Chairman Zimmerman. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner Deemer to recommend that <br />City Council approve Mr. Howard Rohs and Mr. James Monson's request for a conditional use <br />permit, as amended, to erect and maintain an amateur radio tower at 15705 Traprock Street N.W. <br />contingent upon FAA approval of the proposed construction. <br /> <br />Motion carried. Voting Yes: Acting Chairman Hendriksen, Commissioners Bawden, Deemer, <br />LaDue, and Terry. Voting No: Commissioner Thorud. Absent: Chairman Zimmerman. <br /> <br />The proposed conditional use permit will be presented to the City Council on December 18th. <br /> <br />Case #3: Request to discuss options for landlocked parcel; Case of Mr. Wayne <br /> Davis <br /> <br />Zoning Administrator Sylvia Frolik stated that Mr. Wayne Davis owns a parcel just north of Fox <br />Ridge Estates which is considered to be landlocked. She explained that Mr. Davis has a potential <br />buyer that would like to build a home on a lot but it does not have 200 feet of frontage on a public <br />road. Ms. Frolik stated that Mr. Davis also owns the adjacent land to the north across Trott Brook <br />but it is not feasible to provide access from the landlocked parcel across Trott Brook to County <br />Road #63. Mr. Davis has indicated to Ms. Frolik that the owner of the property to the east of his <br />landlocked parcel is not agreeable to negotiating the extension of 174th Avenue N.W. from Fox <br />Ridge through their respective properties to provide public access to the landlocked parcel. Ms. <br />Frolik concluded by explaining that Mr. Davis is requesting that the Planning and Zoning <br />Commission review his situation and offer some options. <br /> <br />Planning & Zoning/December 4, 1990 <br /> Page 10 of 12 <br /> <br /> <br />
