Mr. Otto stated ]n checking with the City of Anoka, he was told <br />that Mr. Rychner didn't have a CUP and that they had not been aware <br />of the business operating on the property. He understood that the <br />City has met wlth Mr. Rychner and has asked him to leave. <br /> <br />Mr. Rychner stated no one has asked him to leave the City of Anoka. <br />He did not have a permit because he did not own the land. He tried <br />to buy the land until he found out it was sold to someone else. <br />That is when he started to look elsewhere to locate his business. <br /> <br />VOTE ON MOTION: YES-Deemer, LaDue, Zimmerman; NO-Hendriksen, <br />Thorud; ABSENT-Bawden, Terry. Motion carried. <br /> <br />MOTION by Hendrlksen, Seconded by Thorud, add Item I4a, the <br />current business has operated on the former H & S property without <br />a conditional use permit. FURTHER DISCUSSION: Commissioner <br />Hendriksen felt that is a fact, and it makes no inference to <br />anything beyond that. Chairman Zimmerman and Commissioner Deemer <br />both felt the statement implies that a permit is needed, and they <br />do not know that that is a fact. <br /> <br />VOTE ON MOTION: YES-Hendriksen, Thorud; NO-Deemer, LaDue, <br />Zimmerman; ABSENT-Bawden, Terry. Motion failed. <br /> <br />MOTION by Hendrlksen, Seconded by Thorud, add Item 14a, the <br />consultant to the City of Ramsey has stated in his opinion the City <br />of Anoka was asking the applicant to move his business from Anoka. <br /> <br />VOTE ON MOTION: YES-Hendriksen, LaDue, Thorud; NO-Deemer, <br />Zlmmerman; ABSENT-Bawden, Terry. Motion carries. <br /> <br />In discussing Item 20, Mr. Otto explained it is reflecting the fact <br />that Mr. Rychner has submitted a site plan indicating he will have <br />Areas A and B separated by fences and Area B would be screened. It <br />is somewhat unusual in that the ordinances do not address the <br />proposal of setting up a production line outside. <br /> <br />Referencing Item 19, Mr. Rychner stated he will purchase aluminum <br />cans and melt them; however, he will be looking into that process <br />further after the first of the year. Right now the bigger <br />companies are flooded with aluminum cans and do not want to deal <br />with him. <br /> <br />Commissioner Deemer again questioned the definition of "abuts" as <br />written in Item 21. <br /> <br />MOTION by Deemer, Seconded by Thorud, for the City Attorney to <br />clarify the situation on whether the property abuts the highway or <br />the zone, bearing in mind all the legal ramifications.
