MOTION by Hendriksen, Seconded by Thorud, that we add Item 3Fa, <br />that the applicant has stated that oil from disassembly operation <br />is currently being burned in his furance at their current location <br />with a license. Motion carried unanimously. (ABSENT-Bawden, <br />Terry). <br /> <br />MOTION by Thorud, Seconded by Deemer, to change Item 40 to take <br />out "to be ?:00 a.m. to 8:00 p.m.", and change It to "...the <br />melt-down operation to be 24 hours, seven days a week.'" Motion <br />carried unanimously (ABSENT-Bawden, Terry). <br /> <br />MOTION by Deemer, Seconded by LaDue, to modify Item 43 to <br />Indicate a second sentence "The site plan indicates trees for <br />screening on the east side of the parking area in Area A." Motion <br />carried unanimously (ABSENT-Bawden, Terry). <br /> <br />Discussion continued on Items 44-53. Mr. Otto noted Item 44 is a <br />new one. Mr. Rychner stated he has talked to Anoka County about an <br />application for a hazardous waste generator license, and an <br />application is being sent to him. <br /> <br />MOTION by Deemer, Seconded by LaDue, Item 45, "will not". <br />DISCUSSION: Commissioner Hendriksen said they will be running a <br />home-made furnace with no emissions testing information received. <br />The business has a history of burning waste oil, and he expected <br />that condition to continue. It is a 24-hour-a-day operation, and <br />there is no proposal to make any substantial improvements to the <br />property that he can see, pointing out the gravel parking lot which <br />is contrary to City code. He felt an operation such as this would <br />adversely impair the use and enOoyment of any surrounding property <br />as well as possibly Impede their ability to sel] their property at <br />full market value. <br /> <br />VOTE ON MOTION: YES-Deemer, LaDue, Zimmerman; NO-Hendriksen, <br />Thorud; ABSENT-Bawden, Terry. Motion carried. <br /> <br />MOTION by Hendriksen, Seconded by Thorud, Item 46, that it will <br />be unduly dangerous. DISCUSSION: Commissioner Hendrlksen thought <br />the operation of a home-made furnace with no test documents is <br />dangerous. Mr. Rychner stated there will be testing before it is <br />operational to be sure it meets the criterial and requirements. He <br />has an air quality permit from the EPA. He also disputed a <br />statement made by Mr. Otto earlier in the evening with regard to <br />the City of Anoka asking him to leave. He stated that is not true <br />and presented a letter from Gary Sauer, President of the Tiller <br />Corporation dated May 30, 1990, terminating his ]ease and giving <br />him 30 days to vacate the premises. He said that is the reason he <br />is moving his operation. The Tiller Corporation owned the land for <br />1 1/2 years before they realized he was ]easing it. Chairman <br />Zimmerman read the letter for the record. <br /> <br />VOTE ON MOTION: YES-Hendriksen, Thorud; NO-Deemer, LaDue, <br />Ztmmerman; ABSENT-Bawden, Terry.
